The message I am refering to is No 3220 1day 1hour ago and is headed... Will have another go. There must have been a problem with computer, Could you have a look at the message and give your views and advice please,,,Steve

The most appropriate course of action in this instance would be to appeal the decision. You have ONE month from the date of the letter informing you of the decision to appeal. You need to use a GL24 form which you can get here.

GL24

You can also use the guides from the members section giving guidance on how to appeal a DLA decision.

Hi Gareth,Thanks for the reply, I was getting a bit anxious. Do ask for a copy of the medical report the DWP requested from my wifes GP and consultent ? would this be helpfull ? steve

Perhaps this is one for Jim, he being an ex-DLA appeals panel member, but I would have thought that you would be sent a copy with all the documents relevant to the appeal prior to it being held. Did it say on the decision letter that they had used information from your wife's GP/consultant in arriving at their final decision?

No it did't state they used the medical report from her GP, however when I spoke to the DWP person on the phone he said the Decision maker would have taken it into account as well as the information we supplied on the claims form,and he said it is quite dornting filling in the forms,and you should put down the worst days your wife has as the norm !!! I thought I had done that" You only have to look at the painkillers she is on and the anti depressents to help her cope, not to mention the proof in a MRI scan and several X-Rays of her back and the fact she has undergone a breast reduction to help take the strain off her back. I have to do every thing for her washing dressing, massage through the night'helping her with toilet needs including wiping her bottom, she gets dizzy from the medication and has fallen on several occasions so she needs keeping an eye on.I also help her into and out of the bath and dry her/dress her etc. and she needs my help to attach TENS machine probs to her back to help with pain, Its impossible to do all these things without help " I just cant beleive they can arrive at the decision that they have" Every time she goes for examination at hospital or GP she ends uphaving to take bed rest for a few days. I could go on and on.....Steve ,South Cumbria
