Last week I asked at my doctor’s reception for a copy of the form which he returned to the DWP because I am disputing the award that I have been given by them. I was told today that my doctor said that I should contact the DWP and ask them for a copy of the report! I do not see why he cannot give me a copy and further more I think that I have a right to ask him for any think that is pertaining to me?
From the outset of claim for DLA he has refused to give me a letter supporting my claim for DLA, even when I gave him the “Health Professionals’ sheet and Checklist” I gave the same to my consultant and he gave me a letter immediately.
What I need to know is do I have a right to ask him for this letter under say The Patients charter.
Incidentally he said to me when I told him where I obtained the Health Professionals’ sheet and Checklist that “he thought it pointless!

Hi Steve,
Under the Data Protection Act 1998, you are legally entitled to a copy of any reports your GP has written about you, and he/she will know that. Being 'bloody awkward' springs to mind !!
Contact the Practice Manager of your GP's surgery for a copy.
You are also, under the same Act entitled to a copy of anything that the DWP have on file about you.
So you can ask the DWP also. At least using both methods you will get a copy.

Hello Jim, Thanks for the reply, concerning my GP I reached the same conclusion myself. All my life since the age of 7 I have seen as many members of the medical profession that would possibly fill a medium to large hospital and that is 50 years of experience and in all this time I have only known 2 perhaps 3 people that was understanding and supportive! I have today contacted the DWP and they are sending me a copy of the report. I will wait for the report to arrive then make an appointment with my (sic) GP, but I am afraid when I do see him the cloves will be off!
I have also looked at and printed the patients charter and there too I find that you "Have the right to have access to your health records"

We used to have a gp who was like that, we had so many problems with him. He was rude and when asked to do a report for DLA said that htere was nothing wrong with me!!
We changed surgery about 18 months ago and today our gp rang my eldest son and asked if he would make an appointment so that he could go through an IS medical report. The doctor wanted my son to make sure that he wrote the right thing. Granted that my son has a very rare syndrome but even so I was pleasantly shocked.
