my girlfriend suffers with M.E
in 2006 she put in for DLA and got it no problem
she got mobility
just before xmas 2007 she got worse and lost her job which she went onto part time hours for the last 3 years
so she sent in that she got worse to ask for care componant and they refused it,so she appealed and that is still going through,however her review date came up whilst this is still in progress and they have taken the lot away
question is do you think that putting in the appeal has effected the review,if that makes sense?
she is going to appeal again now but to try and get it again
i mean i dont really understand but where she put some things like walking she put 30 metres,,someone from the dla rand and asked some questions,1 was the walking,she said again 30 metres,but the form says you cant get mobilty because you can walk 200metres,,that with a load of other wrong stuff
sorry if it dont make sense,im not the best at typing things out

Hi lisadg,
Sorry your girlfriend is having such a hard time with her DLA.
It's very unlikely that her decision to appeal the refusal of the care component had any effect on the DWP's decision to refuse the mobility component on renewal.
I'm afraid it's not unusual to give an answer to a question on a form, such as how far you can walk, and have this ignored by the DWP. However, if there was a telephone call in which the same answer was given but the DWP are claiming a different answer was given, it may be possible to check that. The call is likely to have been recorded and your girlfriend can write and ask for any written or typed record of the call and for a recording of the call as well.
It may be, however, that what the DWP are saying is that they don't accept that your girlfriend's evidence that she can only walk 30 metres and consider that she could walk 200 metres. One of the things your girlfriend will discover when she receives the appeal papers is whether the DWP have any evidence, such as a report from her GP, which supports their decision.

Hi,
actually, your girlfriend won't have to wait to find out what evidence was used. The evidence considered by the decision maker should be listed in the decision letter and should say whether a GP or factual report was used.
