thanks sofie.

i totally agree that sometimes they make odd decision, im waiting for someone from community legal advice to get back to me on advice bout going for a oral appeal.

Any other advice anyone can give me about an appeal or your experience of a appeal would be greatly recieved

Hi guys i spoke to the community legal advice today and they think i got a good case for an appeal, they said that they will deal with everything now but will keep in contact all the time to let me know what is going on.

After i spoke to her i rang and physio and asked her if she is asble to write a report n how much care i need and she is will to do this for me, i then had a phone call of the CLA and she asked me if i wonted to go for a Super smething. i cant remember what it was called but she because there has been a change in things I.E my right leg has got bad in the last 3 years and that i suffer from back pain then i could take this route aswell???

Im a bit confussed can someone help me understand what is involved in taking this route and doing the super something and also can i do it and appeal at the same time as i dont want to go down this route and then have to appeal after it asit will take so much longer

Hi Pauline

Community Legal Advice would be referring to what's called a 'supersession' which is where an earlier decision is superceeded by a later one.

Full details on supersession are HERE

A failed supersession can be appealed, I think it explains that in the link I've given.

Sorry its taken so long for me to get back to you i have had a bad couple of days

thanks for that link jima1 i have had a really good ready of it.

the CLA have asked if i have a care plan but i dont have one as my partner is my carer we dont have anything written down. She asked me to if possible write a daily dairy of the help i need, Has anyone done this if so can u give me some idea of what i need to put down and what i dont need to included???

I think that diary plan is pretty much what you'd do in a typical day, what you'd do in that situation and explain any help you need from another person. You may need to explain that aids don't always help. (like I've done below)

IE:
As a visually impaired student, I may put down that I need extra help reading (compared to other people my age) and that glasses and magnifying aids don't help me. It is not always possible for text to be put in an alertnative format. (as I've found out the hard way) Therefore, only a person can help me with reading.

When claiming the care component of DLA, writing a short diary of
your care and supervision needs can greatly improve your chances of
success. It can also be very important when trying to explain symptoms
that fluctuate either during a single day or over a longer period.

The simplest form of diary is an account of your care and supervision
needs over a typical day. Start from the time you get up in the
morning, through a 24-hour period.

Record the time and help you need; why you need the help and the length of time you need help (e.g. ‘8.00am, Needed help getting out of bed due to stiffness in
joints/back – 15 minutes’).

If your needs vary from day to day, you could keep the diary over a
few days, to get a clearer picture of your care needs.
