Incapacity benefit appeal 1 Month, 3 Weeks ago  
Hi im new to the site and wanted to share my story and see if anyone can offer me any help or advice. Im a 27 year old who suffers with Agoraphobia and Panic disorder, in feb I had my IB stopped as I only scored 7 out of the 10 points needed in my medical. I re appealed twice and both times turned down so I decided to take the case to tribunal which was on monday. Because of my condition I was unable to attend so my parents went on my behalf they were asked a series of questions which had no relevance to my capability of work and all the medical evidence was not looked over with them, anyway to cut a long story short the appeal was disallowed and really do not know where to go from here. After a telephone conversation with my local job centre I have been told I can claim job seekers allowance but will have to attend to have interviews etc which once again because of my condition I am unable to do so really dont know where to go from here, Can anyone help???????????? Thanks for reading this.

Hi Kara,

I'm not well myself at the moment, so this will have to be short.

You need to ask the Tribunals Service for what's called a 'Full Statement of Reasons' (SOR) for their decision. When you receive it, you need to contact an advice agency such as the CAB, and ask one of their benefits advisers to read through the SOR to see if the Tribunal have made an error (s) of law in their decision. If they have it can be set aside and a new hearing ordered.
