I am not sure if I followed this thread properly, as my concentration is not always good. However, you are entitled to get a copy of the medical notes that are sent by your doctor to the DWP. The form to do this is called:

Request for Further information DATA PROTECTION

The form gives you the option to request computer or clerical files that they hold in relation to yuor medical records. You will need to state dates that you require in relation to information you are requesting.

I made my request under the DPA as it gives the DWP a legal framework to work in, plus the request was sent recorded delivery.

Anyway, was going to post this info as a new subject heading, but do know know how to do it yet.

Thanks Fred.

From the letter I received back from the DWP. They seem to suggest that if you want to see a copy of your Medic's report before it is sent to them. This is something you have to arrange with your medic. This request seems not to be covered by the consent they seek on the application forms DBD551 etc. that they ask you to sign.

Hi Fred,

Personal information held about an individual can always be gained under the Data Protection Act 1998. It's only necessary to use the Freedom of Information Act 2000, to request information from governmental departments that is not available in the public domain.

Both Steve and I have made numerous requests under the FOI Act to gain access to information not in the public domain, so I'm sure Steve will confirm what I've posted.

Both Acts explain an individuals rights to seek personal information about themselves, using the DPA and that held by public authorities which is not in the public domain, using FOI.

I am looking to correct some information submitted innocently by my doctor. I have written to the DWP under the auspices of the DPA to correct this. I will let you know how this goes when I get the reply.
