I had my assesment with ATOS, a few weeks ago, i then received a phone call saying I had scored no points, and basically they were finding me fit for work, and I could sign on for Job seekers, not possible for me Im afraid, When I received my letter stating the reasons why I had no points, it stated I go to the park every day, which what I actually said when asked if i go out, was my husband takes me to our local nature reserve which is a two minute drive, where I sit on a bench, it then said I was able to undo, and do up a zip with no problem, I had no coat the only zip i had was on a very small bag, also I adjusted my hair which what I did is I moved my fringe.

I explained all this, and was told I could have a mandatory reconsideration which I wanted,,
Today the lady from the benefits office has rang and she was realy nice and went through everything again with me, and asked all about my daily life and how I get about,and my reasons why I disagreed, she also had a letter from my Doctor, she did say she couldn't understsnd why I had been given no points, but at the end of it she said she could change the decision but would have to speak to someone else, as just on one of the descriptors I should have got 15 points.

Anyway she has just rang and said I have the required 15 points so didnt need to go any further with the rest of the descriptors, but I could if I wanted to, but she was now placing me in the support group, what does that mean for me, I used to get incapacity, but after the time period went on to wrag, CB, and have been in wrag ever since but getting no payments because I have a husband who works, what will happen now.please.

I think you need to wait for confirmation of the Decision in writing but it should be good news.

You need to score 15 points across all of the Descriptors to be placed in the WRAG, however some of the 15 point Descriptors correspond to the SG Descriptors, I believe from you post that the Decision Maker has decided that you meet one of these and this is why they have placed you in the SG.

As you were previously receiving ESA(CB) and your payments were stopped due to the 365 limit, they should now be re-instated from date that you returned your ESA50 as this should be the date that the Change of Circumstances was notified to the DWP, there should also be back payments f the SG rate from this date as well.

Thankyou very much, it just all seemed too straight forward, with no letters to send or any more forms to fill in and the advisor was so nice, she just said I will be placing you in the support group,and would inform the benefits office I was quite stunned realy and didn't ask anything else, like for how long, i will see what the letter says, but I am so pleased, she looked at me differently.

I would like to thank you, and this forum for all the help and advise to me and all the many helpful guides which i have read many times, I will be back I am sure and will let you know when I get my confirmation, I hope they cant change their mind now

As I have posted before after a mandatory reconsideration I was placed in the support group, I have also had a letter confirming this, I was previously alimony incapacity benefit, but then the new rule of 365 days came in and at the end of that I was placed in the wrag contrition based, as my husband works my payments stopped.

I thought being back in the support group my payments would start again,as I have heard nothing I have just rang them and a person has told me it looks like I am in the support group with just credits for my national insurance, but I was getting them anyway in wrag, and truly I worked enough years any way I don't need any more credits.

He also said what it meant as well I wouldn't have to attend the job center, but why would I put my self through going to the job center anyway, if they weren't going to give me any benefits,

Now I thought the support group meant my benefits would start agsin, otherwise what is the point of the stress and struggle it is going for a medical, I am no better off than I was before .

Is this right, he has now gone to check it with somebody else.

Hi MK,

There are different scenarios !!

I have tried to deduce from your previous posts whether you have been placed into the SG now, as the result of a request by you for a review/supersession of an existing award due to a change/deterioration in you condition, or as the result of an MR.

Either way, payments of CB ESA in The SG should be reinstated, at least from the date of the supersession, if that was the case.

Have a look at the different scenarios on this FAQ and see whether they help to clarify the situation : 12 Month Limit for ESA(CB)
