Hi MK,

It looks like you may already have the answer to your query in : Gordon's Response.

Your payments of CB ESA (in The SG) should definitely be reinstated !!!

I've just had a call from somebody else in benefits, and he says I need to fill out a firm and he's going to send it to me, to make sure nothing has changed eg marital or financial status, I asked him about what the other man had said but he says my benefit should definately be reinstated , I also said my husband worked which is why I can't get income based , but he said the benefit I will get wont be affected by my husband working

I am confused now do you have any idea what firm I have to fill in

I expect it will be an ESA1.

When a claimants ESA(CB) payments are stopped by the 365 days rule and they are not eligible for ESA(IR), the DWP close your ESA claim on the computer system, they cannot start your payments again without creating a new computer record but no longer have the information to do so which is why an ESA1 is issued.

Just complete it as a Contribution Based claim and return it and your payments should start shortly after.

As I haven't heard anything yet I have rang them today, and they now say it is with somebody for reconsideration, Im not sure what that means, if my payments wont start again after being put back in the support group, I have to wonder why they had me fill in all those forms, and why did they bother with the mandatory reconsideration in the first place
One person I spoke to said I have enough contributions, so don't know whats going on

Does it usually take this long do you know
