badly written esa 113 was created by Rachie
any advice greatly received.
What can you do about a very poorly written esa113.It has 13 words in total and most of my diagnosis missing and no meds on it.Wasn't my gp that did it.
My gp I am unsure if she will help or do anything as I hadn't seen the esa113 but asked for supporting letter as had suspiscion it was poorly done at last apponitmant but told no.

Can I ask for another one to be done and do atos have to accept it? or do they send another one if she is willing to do it.No boxes ticked to support what I said on my form or how I am affected So am not surprised I now have to have medical. they also didn't keep a copy of it and told me it had not been sent ,it was atos that told me and had to send a copy to my surgery as I asked to see it Iam transferring from incapacity.
has anyone had such a situation and had a dr do something about it ?

I am sorry to hear this !! :(

You are not the first member who has suffered a poorly filled in ESA113.

ESA 113 Questionnaires are only sent out in around a quarter of all ESA assessments. Unfortunately, of the percentage of ESA113's that are sent to a G.P. only around a quarter of these are filled in and returned to DWP/ATOS.

This happens even though G.P.'s are contractually obliged to fill in such forms for The DWP, and are paid a fee.

G.P.'s are not contractually obliged to provide reports or letters of support for their patients, even if the patient offers to pay.

You could take a copy of The ESA113 in question to your usual G.P., and ask whether they would be prepared to amend it.

You could take up the poor quality of information in The ESA113 with The Practice Manager.

You could request copy of your G.P. records to substantiate any medical conditions.

You would have to make a Subject Access Request (SAR) to your practice reception. There will be a charge, and it could take up to 40 calendar days.

As you will have seen, Questions 6-7 are pertaining to whether you are able to attend an ATOS face to face.

If this has not been answered favourably by your G.P. this could be why you are being required to attend one.

You are allowed to re-arrange once.

If a claimant disputes that they cannot attend a "medical", generally ATOS insist that the claimant's G.P. faxes them to substantiate this.
