Hi Val. I just wanted to say the when the DM phoned me, she too refused to take my MR request on the phone and said that I had too wait for the decision letter first.

update: As we already knew, the decision is a no with zero points. I asked how they managed to arrive at the decision within a two day period given that they don't work weekends and she said the decision had not been decided until this morning 18th. I seriously doubt that. If I had chosen the Tuesday (after the Monday phone call) then that would have been within just 3 days. I question if they've even read the form or my answers to the descriptors.

I also requested a Mandatory Reconsideration which she refused to put into motion insisting I need to wait for the form despite me saying I would follow that with a letter my niece would do for me. She also seemed to imply that she would be the one doing the reconsideration, I sincerely hope not.

She wasn't interested, as the ATOS male nurse was not interested, in hearing me clarify the issues I have in regards to the descriptors and kept cutting me off or talking at the same time.

So the fight begins again.

Why oh why do these DWP "people" have to be so ignorant ? :angry:

As you may already know, you will not receive Assessment Rate ESA whilst your MR is ongoing.

Depending on your monetary situation, you may have to sign on for JSA during the MR process.

Either way, you should obtain a fresh "Fit Note" from your G.P. to cover you from the date of the fit for work decision.

Whether you have to claim JSA, or not, do not send the fit note to The DWP. Keep it safe, then if your MR is unsuccessful, and once you have received you MR Notice, you can appeal directly to The Tribunal Service.

It is then that you should send the fit note to The DWP, (Keep copies) this will entitle you to Assessment Rate ESA from the date of the fit for work decision. (Covered by the fit note)

If you do sign on for JSA, you can revert back to ESA, once you have the MR Notice. Again it would be then that you sent the fit note (Keep copies) to The DWP.

Any monies that you had received as JSA would be deducted from any amount of Assessment Rate ESA that you may be entitled to.

Unfortunately she was very specific about me waiting for this letter from her for whatever reason, before requesting the MR.

Could be something new or a DWP person wanting to be awkward, now there's a thought :dry:

This is probably why they do it to save a few pounds here and there. My MP last year put me in touch with IDS who put me in touch with someone else, who put me in touch with another stranger, who passed my letter on till I eventually ended up with a clerk from some corner office who never bothered to reply! :P I'm used to them by now but if I can be a thorn in their side I will be so. Keeps me going and gives me something to fight.

As to the sick note: I am not sure what to do in regards to that. I only just put a new one in that was due on the 15th. Do I still need to request another one? I do have a copy of that one.

She asked me if I wanted to claim JSA I said no and that I was not capable of work.

Hi V,

The fit for work decision supercedes the Limited Capability for Work (unfit for work) that is given by the fit note, so it would be best if you could obtain a fresh one to cover you from the date of the fit for work decision. Keep it safe.

It is possible to agree a reduced, tailored Job Seekers Agreement in line with your limitations, whilst the MR is ongoing, if you are short of money.
