Thank you so much for the prompt advice and points to consider. I will keep you posted on the MR decision and fingers crossed I will be successful in my attempt to get at least another point to receive the Higher Rate Daily Living Allowance!

Dear B&W

I cannot believe how quickly the DWP are working at the moment and have just received my MR decision exactly 4 weeks to the date from my submission! Due to my ill health I did not finish compiling my further evidence to submit to the DM for consideration. I therefore have not received anymore points and remain on 11 points - Standard Daily Living Allowance! I am really disappointed and I believe my only option is to Appeal?

Before I begin the process of Appeal - am I able to ask the DWP for the evidence they considered in my case i.e. The Medical Assessor Report (from the UNPLANNED CAPITA HOME VISIT), Consultants Reports or any other reports the considered in making their decisions?

What would you advise? Any suggestions would be greatly appreciated.

Also, I have not yet informed the DWP of my new diagnoses as mentioned in my previous post - when is the best time to do this? At Appeal stage or should I call them in the next few days?

You should be able to request all of the documents used over the phone although I would follow up the request in writing.

You only have one month from the date of the MR letter confirming that the original Decision is unchanged to lodge an appeal, so whilst you can wait a while for the documentation to arrive, do not miss the deadline for submitting an appeal, you do not need to go into detail on the Appeal form as to why you are lodging an appeal so not having the reports will not matter.

I would not call the DWP about your new diagnosis's but would write, I think it unlikely that it will make a difference at this time but it cannot hurt to try, you should still include this information in regard to any appeal.

Thanks so much for the prompt and invaluable advice and I will phone and write for the reports as suggested and follow the B&W Appeals Guides by the letter!

I am dreading the Appeals process and the thought of going to Tribunal fills me with fear - but needs must and hopefully it will be worth it - I will keep you posted.

I would not suggest that appealing is not a stressful process, but the hearings are usually not as bad as you think.
