I've phoned this morning to the DWP to ask for the Atos PIP medical assessment report for my daughter and they said they'd send it on in 2-3 weeks. Could you confirm that this report is something different from the decision makers report which came with her letter of no award for PIP?

I've sent a letter today requesting an MR saying that I will be making a submission on the basis of how the HP was to her during the assessment - (e.g. saying that the question on needing help with communication was only for those whose tongue didn't actually work). There were lots of these kinds of remarks - he laughed in disbelief when she said she doesn't have any friends) and also pointing out where she should have got points which were overlooked. I'm assuming that this submission has to be in by the deadline? It doesn't give much time between receiving the Atos report and our submission needing to be in so I'm trying to write down everything now.

I'm also getting our MP involved because I just can't do this any more. Is there anything else I've missed at the moment?

Hi Ws,

The letter of explanation that you received from The PIP DM along with the PIP Decision Notice is indeed different to The ATOS Assessor's Report.

This report would have been generated as a result of the PIP "medical" by the ATOS Assessor.

The DM would then refer to this when coming to their decision.

Whilst it may help to point out any irregularities that occurred at the time of the "medical" it is more important to reiterate where and how your daughter should have scored points, where she hasn't.

Have a read through our : PIP MR/Appeals Guides.

You should send this and any evidence that you may have for The MR as soon as possible, as the more information that the reviewing PIP DM has, the more likely that you are to have the adverse PIP decision overturned without the need for an appeal to The Tribunal.

You could always make a note that you will forward any relevant fresh evidence once you have received the ATOS PIP Report.
