PIP Claim was created by Luke
Hi everybody,

So I made a claim for PIP I then had a medical where the woman came to my house as I could not travel, I worked out my points based on my answers and I would of qualified but of course they failed me and when I checked the answers the woman had put down most of it was inaccurate. I then had a call from DWP to speak to me about the decision and I said I wanted to appeal, they said they would call back but I was to ill to take the call.

I still believe I should be entitled to PIP what is the advice on here. should I appeal? , what are the chances of success? should I use CAB for my appeal.

I am new to this website, is there helpful information on PIP here?

Sorry I should of added that the month deadline has passed, I wanted to contact them before the limit but I suffer from bad anxiety and I just couldnt face it.

Welcome to Benefits and Work :)

Have a read through the passage about 2/3 down This article.

Under the heading : "Avoiding dirty tricks" pertaining to PIP.

We always advise that a Mandatory Reconsideration (MR) request, which is the first step in the appeals process, is made formally in writing, making it absolutely clear that you are formerly requesting a Mandatory Reconsideration of the adverse PIP Decision in question.

This should be posted to arrive at The DWP PIP Office no later than one month from the date of the PIP Decision Notice letter that you should have received.

If you haven't yet received this letter, you could still submit the MR request ASAP, and not wait for any further contact from The DWP, by phone or letter :

Sending Documents to the DWP or ATOS

Even though it may help to discredit the recommendations made by the assessor that you speak of, it is most important that you reiterate the facts regarding how your disability affects you as a result of your medical conditions/disabilities.

Only by doing this can you obtain the necessary points for the correct PIP Award.

As it seems that you have not received any level of PIP Award, you have little to lose by requesting an MR/Appeal of the adverse decision.

If you can gain the representation of a trained adviser from CAB or the like. that "should" help.

However, CAB and other advice agencies have lost a lot of funding and it may be very difficult to obtain such help :

Or you could try putting Welfare Rights/Advice for your Town/Postcode into Google.

However, if you do wish to request an MR, you should not miss the one month deadline to post this off to start the ball rolling and protect your MR/Appeal rights.

It is possible for the adverse decision to be changed in your favour at MR without the need to take it further to The Appeals Tribunal.

Hi L,

You can make a late request for an MR if you can show good cause for it being late.

Good cause could be your state of health and the fact that you were told that you would receive another phone call, or you did not fully understand the MR procedure.
