DLA to PIP success but I have a question was created by sleepyhead
I was on DLA since 2012 but lowest rate for care only . As I was not living in UK I was not able to claim higher benefits although I think I would have qualified had I been here. I returned to live in UK in August 2013 and in May 2014 I had to apply for PIP as the DWP could not do a change of circumstances for my DLA. I heard nothing from Capita until our MP contacted the DWP on 19/12/14. Capita jumped into action and on 29/12/14 phoned me to arrange the face to face assessment. I had to phone them back to request a home visit which they arranged for the 12/01/15. Today 28/01/15 I have received the PIP result and have got Enhanced DL and Mobility so am very satisfied.

However this is my query as the award has been dated from the 25/02/15 for 5 years and it was not back dated at all. DWP say the law states that a change from DLA to PIP cannot be backdated.

Surley as soon as the DWP are made aware of my change of circumstances then the benefit should run from that date. It was not my fault but theirs that they took so long to see me and make their decision.

Many thanks to B&W for if it hadn't been for your guides I would have struggled to have the success that I got.

Thanks for your comments regarding B&W.

I am afraid that is correct !!

There is no back dating of PIP with a transfer over from DLA.

DLA will continue to be paid at the rate of the current award until 4 weeks after the date of the PIP Award Decision.

We have had several members making queries regarding this issue.

The only possible justification I can imagine for this is to avoid a potential overpayment if the decision were to go the other way. Either that or the rules have deliberately been devised to the detriment of the claimant. You decide.
