DLA to PIP

Hi, hoping for some advice for a friend. They have been on DLA but recently been turned down in transfer to PIP. Apparently the medical was cancelled at short notice and they recieved a phone call, after this they heard they were not eligable for PIP.

What would the first step be, a mandatory reconsideration or appeal? Getting the reason why they have been turned down, and the background of why they recieved DLA perhaps?

The Decision Letter should explain, at least at a high level, why they have been refused PIP, it would be worth finding out whether this was because they were not viewed as meeting the criteria or whether it was the result of some sore of technical failing.

The first step to challenging the Decision is to request a Mandatory Reconsideration, our PIP MR & Appeal guide explains the process, they should make the request in writing. They should also request a copy of the assessment report, it is worth phoning for this but following up the request in writing.

Their primary goal with the MR is to show that they meet the criteria for PIP, so they should look at their form with the Decision Letter and the assessment report to see where they can explain their limitations in more detail.

Whilst there are overlaps between DLA and PIP there are also considerable discrepancies, it is perfectly possible for someone currently receiving DLA to have no entitlement to PIP, also DLA does not use similar terms to PIP, so they should be cautious in using information from their DLA claim in regard to PIP.

Thanks, all i know is they have had this happen twice in the past and won each time at tribunal. they have significant health problems so it is a shame it seems they may have to go through it again.
