Hi
I have just received standard care + low rate mobility.
So first many thanks for help as haven't had the care rate before.

I have had high rate mobility on DLA for over 10 years so I suppose that's the moving the goal posts system although as you have advised others i have asked for copy of assessment to be sent to me before I talk to case officer/ case manager/ desicion maker or whichever hat they will wear that day.

My husband is on ir/Esa so thought care rate of my pip might give us a top up premium but have been told no as he is in wrag ? Is that correct ?

Also my pip award is for approx 2 years so asked what the review process after that is and was told that policy will be no more f2f after just simple update review forms probably 2 yearly .

Is this true as a lot less worry in the future if it is but you may know better.

If you wish to challenge the PIP awards, I would not wait for receipt of the Medical Report, and/or a telephone call.

The telephone call may not occur, and it can take 40 calendar days or more to receive documentation that you have requested.

if you are to challenge the awards, you only have one month from the date of The PIP Decision Notice letter to request an MR :

If your husband is in receipt of IR ESA, then the fact that he is in The WRAG would not stop the payment of The Severe Disability Premium. (SDP)

It is not the group that a claimant is in that precludes them from receiving IR ESA Premiums, (They can even be paid whilst in receipt of Assessment Rate ESA), it is whether you are entitled to/being paid IR ESA, and you can fulfill the other qualifying criteria.

However, you may be precluded from payment of The SDP for you being in receipt of Standard DL PIP, as you do not live alone, as seen below :

ESA Premiums

You may still be entitled to The SDP, if you live with your husband, and he is also in receipt of MR/HR Care of DLA, or a PIP Daily Living award. (these are the exceptions mentioned in the FAQ above.

Another option if they can't pay you The SDP, is for your husband to make a Claim for: Carers Allowance (CA)

You could contact The Carers Unit regarding further information on the above.

Even though he would not be entitled to the full CA, he may be entitled the The Carer Premium, paid as a top-up to his WRAG IR ESA payments.

Claiming any IR ESA Premiums may involve filling in an : IS10 Form

Or, an ESA 3 Form : Sample ESA 3 Form

An ESA 3 Form may only be necessary if you are not already in receipt of IR ESA.

Is the 2 years the "Review" date, or the length of the PIP award ?

Review/renewal forms will be sent 12 months before the end of an award.

They are allowing 12 months for renewal as the process can take so long.

So, with a 2 year award one could receive renewal/review forms some 12 months before.

I am afraid, not, whether you have to go through another "medical" or not will depend on the information that they already hold, and the information that you provide at that time.

Hi and thanks bro

I am not on ESA as I get carers allowance as our two children have autism ,ADHD,ehlers danos and epilepsy so get DLA.

My husband has aspergers and fibromyalgia and got ESA for thst so we help each other but I have to do all the communication as he can't cope with it .

I have Sle lupus,rheumatoid arthritis,Raynaud's,ehlers danos,sjogrens all fully diagnosed and documented plus went through and survived thyroid cancer 4years ago and got turned down for incadpacity benefit and care rate dla but got high mobility rate at last attempt so I took the carer option to get money coming in.

Just goes to show 1.) How useful your guides have been with pip application as now getting care rate : ) and 2.) How inconsistant assessments are as despite being on 38 meds a day and needing certain day to day help I was declined incapacity benefit by atos.

Wish I had known of this site back then .

I will get onto them tomorrow to ask for MR.

Thought the no medicals info was to good to be true!

My award is only up to Jan 2017 so review forms could arrive in just a few months? Grrrr .

Don't they think I have enough to deal with?

Do you think it possible for my husband to claim CA for me while. I get CA for he kids?

Hi s,

Yes, it would be possible for your husband to claim CA for providing Care for you, as long as he fulfills the : CA Eligibility Criteria.

Care can involve, physical care, or other types of care such as watching over, supervision, comforting, etc, etc.

So it is quite feasible for him to be providing care for you as long as the "Caring" duties are not in direct contradiction to the limitations that gave him his ESA WRAG award.

As he is in receipt of IR ESA, he would have to apply for CA as normal, he would then be informed that he would not be entitled to full CA, as it is an overlapping benefit with ESA.

He would then have to inform ESA that he has an underlying entitlement to CA, and provide copy of the letter from The Carers Unit.

Once processed, all being well, he should be paid the Carers Premium with his WRAG IR ESA which is currently £34.20/Week.

I am only advising the above on what you have written, so I cannot guarantee categorically that he would receive it.

CAB or AGE UK (if you are over 50) can carry our free benefit checks for you, or you could even contact Carers U.K.

The CA Carers UK link that I provided has some very good information on CA.

Regarding the PIP MR, you should be aware that there is always a risk involved when requesting an MR/Appeal of an adverse decision.

They may choose to re-look at the "whole" of the PIP awards once more, so you need to risk assess how safe your Standard Care award is, did you just scrape it ? how many points were you awarded ? etc, etc.

You can stipulate that you are only challenging the Standard Mobility, but they can re-look at the Daily Living as well.

This is all covered in our PIP Appeals Guides.

I will now pre-empt a very common follow on question that is often put to us, I cannot advise you on whether you should request an MR or not.

I am afraid that is only a decision that you can make !! :)

Just to make you aware, if you have received The Standard PIP Mobility for "Moving Around" the physical test, rather than the "Going Out" mental limitations test, then this entitles you to a Blue Badge and 50% reduction in Road Tax of a vehicle that you have the use of.

If your PIP Awards are until January 2017, then your renewal/review process should begin circa Jan 2016.

Many thanks for reply it is much appreciated.

Having read your information and looked again at my award I think I may just accept the rates given as I got 9 points for care and was so pleased to get that.My 10 points for mobility are for physical moving around which I do think is harsh as do struggle to do 10 yards some days.Great news about the half priceroad tax as it just stated I could no longer get free tax in letter and was upset about possibly losing my blue badge so your reply really cheered me up.

Bro,

Are you sure about that regarding IR ESA and CA? I always thought underlying entitlement was only achieved with CB ESA and CA, and in the case of IR ESA, CA is fully payable as a benefit in its own right, and is deducted £ for £ from the IR ESA, but then the Carer Premium is paid on top.

Certainly that is the case for my dad's Pension Credit and I would have thought IR ESA would be the same as both are means tested?

Or are you definitely sure that underlying entitlement and no actual payment of CA is the case with IR ESA and not just CB ESA? The reason I seek this clarification is that it becomes very important if anyone is to claim the SDP because one of the criteria is that "nobody gets CA for the claimant" whereas if they have underlying entitlement and a Carer Premium, but no actual CA, the SDP is still payable (assuming they meet the other conditions).
