Still having problems with ESA assess rate.
Phoned yesterday to check progress,told JSA claim had been closed but ESA not back in payment and that it might take another day or two to show on system and to phone Mon if payment hasnt gone in.Didnt trust what call handler said so phoned at 8am today, after lengthy explanation of case to call handler they were about to look at the notes on the system when i was cut off! Rang back, after long hold was just about to speak to call handler when line went dead again!Third attempt ,mentioned being cut off ,told they would phone me back if happened again.They said there was a note on system that i was due a call back fron benefit centre dealing with claim in next 3 hours.
Call back ,they said still some sort of problem at JSA end and they are chasing it up,also said they have not had acknowledgement of appeal even though i sent a copy recorded delivery in march and DWP have sent appeal papers.They said they would contact me when they have sorted it.
Feel i am banging my head against a brick wall - two recorded delivery letters sent ,half a dozen phone calls ,several call backs and still not sorted!
Is there any point in sending things recorded delivery if they still get lost?

Yes, there is, at least you have proof that the DWP have received your letters/documents.

Have you contacted your M.P. yet ?

Contacting your MP

I know that they may be busy with the Election Hustings but it may well be worth a try if this matter has no been sorted out by next weekend.

It should be a simple straightforward matter to revert back to ESA !!!

If you are still having problems getting the documents to the DWP, another option is to make an appointment at your local JC+, they can scan the documents and email them direct to the relevant department.

Hi tb,

Gordon has come up with a very good suggestion.

This is commonly known as an AJAX !

AJCS : Accessing Jobcentre (Plus) Customer Services.

You have to make an appointment before hand, you can then visit your local JC Plus Office with the necessary letters/documents and get them to scan them straight to the relevant department.

They can't possibly state that they haven't received the document/s then !!

First the good news,
Had Tribunal on Mon
Went from 6 points from atos to 24 points and placed in support group under REG 35.

Now the problem
Still not being put back on ESA at assess rate
JSA claim definitly closed as had confirmation letter on sat.
When i phoned last fri 17 and given call back from benefit centre dealing with claim told it would be sorted within next few days and they would contact me.I would of being due a payment mon 20th if it was sorted as last JSA payment mon 6th.

Phoned today and told by call handler that it was showing a request had been made on mon but it can take 28 days to process? When i explained about what was said in call back on fri she just said she couldnt comment on that.She also said she couldnt chase it up until the 28 days had passed, no matter whwt i said she just kept repeating her 28 day mantra.
Realised i would get no where with her so said thank you and hung up.

So now i am in benefit limbo

Could the request she referred to actually be the tribunal result which was emailed to them on mon and could the 28 days be because the may be requesting statement of reasons before giving me any ESA even at assess rate?

Dealing with the DWP has become like some bizarre mixture of Catch 22, One flew over the cuckoos nest,Alice in wonderland and Orwells 1984!

Any further advice please.

It's not impossible that this latest delay is the result of your Tribunal result, but our experience of the DWP is that they do not work that fast and even if they did the result does not impact on the payment of the Assessment rate although the DWP may argue differently.

I'm afraid I can't offer any additional advice on how to progress this, I believe you have already had a call back, but you can try escalating the problem to a manager again.

Did you contact your MP? It's likely that they will be distracted by campaigning but their office may still be able to apply some pressure.

You might want to wait until your Tribunal result is processed but I would certainly be considering a formal complaint, if you can show that the delays have cost you financially you should include information if it has.
