dwp have sent me someone's full esa medical report

I really hope it's not my report as I am waiting for it. I don't have words to express how awful this is.....speechless. Good for you raising this with your M.P
I have just received my award, but only in the form of the DWP telling me of a change in my money due to being placed in the WRAG group. I haven't had any report or anything. Can I expect one or do I have to request it? Your advice would be truly appreciated.

Hi Jj71,

You do not receive ESA Medical Reports as default, you have to request them.

It would be an ESA85 if you had a face to face or an ESA85A if you didn't.

There might also be an ESA113 Questionnaire if one was sent to your G.P. to fill in :

ESA medical – what forms to ask for?

You can request these over the phone :

THE ESA PHONE NUMBER DWP : 0345 608 8545 Press Option 3 for ESA.

If you have any trouble obtainiing these with a verbal request, you can make a written request.

You can do this using a SAR Form :

DWP Data Protection Policy

Or you can make the request in the form of a letter, as long as you make it clear that you are making a formal SAR under The Data Protection Act 1998.

Address the envelope : FAO The Data Controller, at the Benefits Office dealing with your ESA.

Write DPA 1998 SAR in front, top, left corner of envelope.

Once received, they have 40 calendar days to comply.

Sending Documents to the DWP or ATOS

There should also be an LT54 Form, which may contain useful information.

ESA Forms

You should be able to obtain the ESA85 or ESA85A via a phone request.

However, it is likely that you will have to make a written request for The LT54/ESA 113.

Thanks for posting all this info - I am about to begin my fight back after receiving no points at my ESA face-to-face. I am finding it so stressful, even though I think of myself as a strong person it is taking its toll already. Am seeing someone at CAB in the morning - he previously helped me with a complaint I had with ATOS.

I had my face-to-face recorded - was in that long a second CD was needed. Having listened to both CD's I cannot believe how things have been twisted, how many times I was interrupted and not allowed to continue etc. However, I need to focus and dig my heels in.

I requested my ESA85 on the Wednesday I received my 0 points notice and it arrived on Friday same week which I thought was exceptionally fast just unfortunate that it contained someone else's too!

I have heard little from the security team apart from the full name of someone who is advising the team manager but I was told, again, that I would be kept informed of what is happening.

Just a quick update on receiving someone else's info.

Had a letter from DWP awarding me a 'Consolatory payment' of £25...... for any 'stress' this [incident] may have caused me.

If they think this is stress what do they think assessment, mandatory reconsideration and appeal processes does to us all.

This happens to me three weeks ago, my husband phoned to inform the DWP that. Although it was my name and address the person in the reconsideration letter wasn't me. He was nice
to them on the phone, and although i am waiting for a similar letter he did not become annoyed. Four days later I received another letter Now they want to see me under caution and I am terrified .It is only twelve months since someone reported me so I was seen by a compliance officer
(obviously cleared )then November 2017 when I was seen by pip assessor and now this. I am beyond wound up , fed up, tressed to the point my Dr has upped my antianxiety to highest does and I have to be fitted with a 24hour bp monitor because it is so high. I have never felt like ending it all before even when the drs were going to remove my lower jaw through infection and loose my leg because of neverending nerve pain, but I do now.
Worse thing is the people who are putting us through this would be happy because they wouldn't have to pay me anything anymore. (so sorry to rant )
