Hi,
I am unsure about the rules of ESA. I find it all so confusing especially following brain surgery. I am currently in receipt of SDA. My husband works full time as does my Daughter, who lives at home.Will my claim be means tested? Will I still be entitled to claim ESA? ,My Daughter will be moving out to her own place in the near future but until then will her income affect my claim?
With SDA, I was exempt from something but cant remember exactly what it was but would it still apply when claiming ESA and if so will they know this?
Should I put exactly the same on my ESA application as my PIP forms when explaining, even if the questions are not identical?
The ESA application address is Atos, however I assumed ESA claims were dealt with in local Jobcentre plus offices. Very confused!

Hi Amber,

As you are on SDA you will be transferred to Contributory ESA.

What will I be transferred to?

What will I be paid?

If placed in the WRAG you would be paid for 365 days and then it would become means tested. There is no such limit of payment if you are allocated to the Support Group.

12 Month Limit for ESA(CB)

Your adult daughter should be considered 'non dependent' and her living with you should not affect your ESA. However, as your husband works full time, this would mean that you would not be entitled to Income Related ESA.

24 hour work rule for ESA(IR)

When moving from SDA, you should get 'transitional protection' so that ESA would pay no less then you are currently getting. As I do not know what it is that you are exempt from, I cannot comment about whether this would continue on ESA.

You need to make sure that you have answered the questions fully and given the relevant information. It is likely that this will only correspond with the PIP application in one or two places.

ESA applications (and DLA/PIP) are dealt with centrally, they are nothing to do with your local job centre. A new organisation will take over ATOS soon but you should send the claim to the address given.

Just one more thing. I also have a problem with my bowels and bladder and feel rather embarrassed about explaining this on my ESA forms. I read somewhere that your medical information you supply isn't private and as I know people ( not friends ) who work at my local job centre plus, I am worried that they will have access to my ESA forms and medical evidence. Would it make a difference to my claim if I left this information blank even though it is on my PIP forms?

Hi A,

We do advise that you provide all information regarding any medical conditions and resulting limitations that you suffer.

Your personal medical information cannot be shared "willy nilly", if this occurred, they would be in trouble.

Only Medical Services, and The DM making the decision should actually see your information.

Even if other employees did see it, they are duty bound by The Data Protection Act 1998.
