Hi just hope you can help, I have been for my assessment to atos, they have refused me 2x and now I am going to a tribunal. my question is how can the make a decision when they havnt asked the GP and Specialist for any medical reports because this is whats happening to me. hope you can help.

Hi I am sorry for this question but I am not sure how to get the best results from your site, I need help with my appeal as its going to a tribunal, I feel I have been lied to has all my answers to the assessor at atos were different to the ones I give him, ie I said I cannot prepare a simple meal due to osteoarthritis and pain in my hands especially thumbs, he said I could prepare a meal. Who is he to make a judgement on me in a 20 min assessment and give different answers to the ones I gave him. One very angry and annoyed person. thanks

Hi Sharon and welcome to the forum. On the assumption that you are also new to the site, this link should help you find your way around.

The DWP stance is that ATOS (and now Capita/Maximus) are experts in disability assessment whilst our GPs and specialists are experts in the disease process rather than the way it limits us. They do not have to seek information from your medics and rarely do so - that is why we recommend that claimants send in as much evidence as they can with their claim forms.

If you did not use our guides to help fill in the claim form, it would be worth looking at them now so that you have an idea how best to present your limitations to the Appeal Tribunal. You have not said which benefit you are claiming so I will give you the links for ESA, DLA and PIP!

Thank you for the reply and the links, I have read these and have found it interesting. Although I do feel like the Atos assessor just looked at me and made a judgement that I was ok. Why would he say different answers to me, he made me out to be a lier, of which I am not. I have trouble with my hands and can not grip very well and suffer with the shakes which doesn't help. wots wrong with these people.

It would help us if you would confirm the benefit in question, you refer to preparing a meal so I assume it is either DLA or PIP.

You need to separate opinion from fact when looking at the assessment report in regard your appeal, as an example; the report may say the claimant walked 25m from the waiting room to the assessment room (a statement of fact) versus I believe that based on my observations of the claimant walking from the waiting room to the assessment room that they can walk at least 200m (an opinion).

You primary goal at the appeal is to show that you meet the criteria for the benefit, it is only once you have done that that you should turn your attention to showing that what the assessor has reported is either factually incorrect; whilst I did walk from the waiting area to the assessment area they assessor has failed to note that I stopped twice for over a minute each time due to sever pain in my legs that is a result of arthritis in my ankles and knees, and their opinions; the assessors opinion that I can walk more than 200m is not based on the observed facts or the information contained in my claim and attached pages, at no time am I able to reliably walk more than 10m without having to stop due to ... ... this is confirmed by my consultant on page....

If your claim is for PIP then actions must be done Reliably this means

• Safely – in a fashion that is unlikely to cause harm to themselves or to another person.
• To a necessary and appropriate standard – given the nature of the activity.
• Repeatedly – as often as is reasonably required.
• In a timely manner – in a reasonable time period.

Thank you for the replys, I have just been to occy health through work and he has told me that hes saying I cannot do my job anymore and that I cant work for 3 yrs. I av ongoing treatment and investigations, but it still feels to me like know one understands how much pain I am in, I am starting on pain patches and have to go for an mri scan to see whats going on, can I use this as proof at the tribunal for PIP thank you
