I have been awarded standard rate care and enhanced rate mobility for my PIP claim. I have worked for the last 22 years and paid all my NI contributions. There may be a possibility of me taking early retirement from my work. This really appeals to me as I finding working a struggle. If I were to be offered this and had a pension from my work could I put in a claim for ESA i.e. claim it in addition to a pension? Also if I did take early retirement I would have a lump sum. Could I use this to pay off my mortgage or would that be counted as "getting rid of the capital"?

I am sorry but we cannot give detailed financial advice on the forum, you need to get face to face advice from a qualified advisor before proceeding, do an internet search for "welfare advice" with your postcode , town or county.

To claim ESA you need to be certified as unfit for work by your GP (i.e. receive a Fit Note) and in the longer term show that you meet the criteria for an award. Have a look at our ESA Claim guides for more details.

If you are eligible for Contribution Based ESA, this will be dependant on your NI Contribution history during the Tax Years 2012-13 and 2013-14, then the first £85 per week of any pension will be disregarded followed by a £1/week deduction for every £2/week in excess of the £85.

If you are not eligible for ESA(CB) and can only claim Income Related ESA then any pension would be deducted £ for £ from your benefit.

If you were receiving ESA(IR) then I think there is a good chance that your paying of part or all of your mortgage would be counted as deprivation of capital. If it is ESA(CB) then there should be no issue, however, if you are placed in the WRAG then you would only have 365 days of entitlement to ESA(CB) after which you would need to claim ESA(IR), this could re-introduce the issue.
