hiya bro I understand what your saying , I got 12 points for my motorbility component does tht mean its sfe how do I find out if its safe ???

Hi momx,

When I say "safe" what I mean is would any of your existing PIP Award/s, Mobility or DL (care) be vulnerable to reduction or loss when the DWP carry out a Mandatory Reconsideration (MR) at your request if you decide to challenge their decision.

With PIP it is possible to receive a lot more than the points needed for an Enhanced Award i.e. 12 Points.

The fact that you have just managed to score the 12 points needed for Enhanced PIP Mobility and not more than this would lead one to believe that the Enhanced Mobility may be more vulnerable than say if you had received 16 or more points.

Again with The Standard Award as with your DL (care) Award you need to score at least 8 Points.

The fact that you scored 9 points may indicate that the Standard DL Award is more vulnerable (un-safe) than if you had scored 11 points.

Even if you make an MR request stating that you do not wish to challenge the Enhanced Mobility, there is a chance that they could still re-look at it.

Although it is not common for someone to have their existing award reduced or stopped it has happened in the past.

You see if this was at the appeal stage with The Tribunal, they would first have to warn you that they were thinking of reducing or stopping an existing award, therefore giving you the opportunity to withdraw your appeal and "stick" with what you have got.

The DWP do not have to pre-warn you at the MR stage, although if they did decide to reduce or stop one or more of your existing awards, you could then go forward with an appeal to The Tribunal Service.

However, whilst waiting for The Tribunal Hearing you would only receive monies for the reduced award, or no monies at all for an award that was stopped as a result of The DWP's MR.

There is always some risk involved when requesting a MR/Appeal, unless of course your MR/Appeal is as the result of no award/s at all.

So your current awards need to be risk assessed to see how "safe" they are.

CAB or Age UK may be able to do this and advise further.

I am worried about you challenging the current awards by your self, as you seem to have struggled to grasp the full context of the PIP qualifying criteria ! :(

If you can gain assistance this may well improve your chances of success, however as previously stated, unfortunately that is only a decision that you can make.

I am therefore trying not to sway you one way or the other.
