:( HAD MY APPEAL TODAY :( IT WAS HORRENDOUSE it was supposed to start at 11am i was still waiting at 12/30 when i was eventually called the judge was pleasant an explained what was going to happen the benefits lady was also pleasant BUT[ the doctor was horrendous :( ] he didn't just ask questions he treated me as if i was a criminal he interagted me i was shaking really anxious and was bordering on having a panick attack and this went on for over an hour [if i had realized it was going to be like this i would have never have gone] no wonder people don't turn up i was awarded 13 points for care and 4 points for mobility i was disappointed not to score more points for mobility When i left i was physically and mentaly drained :( i would like to thank GORDON [he answered most of my posts] you deserve a medal for the good work you do if it hadn't been for your advice and kind words i would have given up a long time ago because if it wasn't for people like you people like me wouldn't know what too do i would also like to say thank you to all the moderators on here you are all brilliant :) i will keep my membership as no doubt i will need your advice in the future and id like to wish all the members good luck with theyre claims and appeals SO once again thank you all from the bottom of my heart :kiss: :kiss:

Congratulations on your win and thank you for your comments about the site.

I've had several Tribunals I can remember one was terrible and another was very good, I would not describe any of them as a pleasant experience. The important thing is they obviously believed what you were saying to have made an award.

It usually takes the DWP 5-8 weeks to process a Tribunal result, I would give them a call next week just to confirm that they have received the Decision Notice, even though it is emailed directly to them on then day that the Decision is made, they still manage to go missing.

HI GORDON finally received my back payments for the award of pip I had at appeal on the 4/11/15 and also back payment for the severe disability payment :) just a quick question I received the statement of reasons from the appeal today whilst I agree with all that was discussed about my mental health problems for wich I was awarded the enhanced rate but the reasons for only being awarded 4 points for the mobility part I do not agree with they only mention that I have arthritis in my right hip but they had a letter from a rheomatolagist stating I have it in both hips and lower spine and im awaiting an appointment with a pain management clinic and they also stated that if it was not for my severe mental health I could manage my problems with the arthritis and it states when I entered the room I walked very slowly but in their opinion I could walk over 200meters with no problems I know I should be grateful for what I received although I had to fight for it :( I cant appeal to upper tribunal because as you have told me before there has to be an error of law so in your opinion should I wait a while and them inform them about a change in circumstances because my mobility is really bad your advice would be appreciated thank you in advance kim

Yes, you can report a change but you may need to show that there has been a deterioration in your walking since the date of the Decision you appealed.

You can ask the DWP to just look at the Mobility component, but the reality is that they will look at the whole award from scratch and as this means you will need to complete a new PIP2 in detail and will likely be required to have a new assessment.

A new Decision will be and made this could result in your current award being removed, so you need to include this in any decision about whether to proceed or not.
