had a phone call regarding the above I asked why the MR was done In 21 days and also the fact I had sent the 2 letters 3 calls regarding the extra medical evidence and also the points I have raised with the FTF he said maybe it would be a good idea to go for the appeal because they would look at the points regarding the capita report I said no I want a 2nd reconsideration after qiute a long chat he asked me some of the things that were in the capita report and the n said he will hold on to my file until I get the extra information over to him wich he will go through and then ring me

THEY WIN :( received letter yesterday after sending all the extra medical evidence he awarded me 4 points for planning and following a journey[need prompting from another person to under take a journey to avoid causing you significant mental distress and to keep me safe] he still says I can walk over 200meters even though the capita assessor did not see me walk I raised this with him in the phone call and also he says I have no restrictions in my lower limbs [even though he had a medical report from a consultant rheumatologist stating I have osteo arthritis in both hips and lower spine and I suffer with chronic pain and need to be refered to a pain management clinic and also half of the decision makers reasoning is missing a large paragaph is in transcript :( SO THEY WIN I GIVE UP you fill in the forms you send medical evidence you tell them l the how your disabiltys affect you on a daily basis and they just disregard everything you say so I give up they only believe the capita asseser i cant take any more thanks for all the help BW have given me in the last couple of weeks its been invaluable :)

You still have the option of making an appeal.

We don't have any figures for Decisions being changed at the MR stage but I would be surprised if it was as high as 10% on the other hand successful appeals are at about 40% if you attend, obviously these are just statistics and don't always apply to the individual but you would have an opportunity to re-present your case and if you attend you can explain your problems to the panel.

Hi Kim,

Sorry to hear about this.....I understand exactly how you feel right now but please consider putting in an appeal.

They know many people don't have the energy or the capability to take things as far as appeal - that's why they do this.

If spending some money is an option for you, there are solicitors who can do this for you for fixed fees.

thank you once again for your reply I understand what you are saying but because of my mental health problems I know I would not be able to go to a hearing because when I get really anxious I suffer with panic attacks and that's if I could leave my home to go and everything ive read regarding the appeals it says oral hearings are not successful so I just feel what is the point of going through all that :(
