Forgive me but I don't understand why you have lost your automatic entitlement to HB?

From the figures you have supplied your husband should still receiving Income Related ESA and I would therefore expect the HB to remain in payment.

Hi Gordon

this is what Dave at DWP said :

OH is no longer on Income related ESA

He is now "back on" Contribution Based ESA SG

His Applicable Amount calculates as :

114.85 ........couple rate
36.20 ..........Support group
22.60...........Enhanced Disability ( he gets HR care )
34.60...........Carers Prem ( my underlying entitlement)

£208.25 MINUS £ 109.30 my ESA SG .
£98.95

SO ( dwp says) this is LESS than his entitlement so THEY pay him £109.30 ESA (CB+ SG )

Therefore he is no longer entitlement to means tested ESA as our "income " is more than the applicable amount. ??????????????
= no automatic HB/CTB advised to make a fresh claim . My calculation is we are £10.35 pw over the HB applicable amount too?

OH has medical exemption for prescriptions . I don't

our rent liability for HB is £146. 68 pw ( NO spare rooms as now exempt)

i was wondering when the Disability Premium of single 32.25 couple 45.95 comes into play? OR is that used just for HB ?

Housing benefit ( she says spitting)

after 2 yrs of bedroom tax, appeals, dhp. illegal recovery, and then under payments , now recently paid .

IF my OH is now on esa cb and NOT IR , does this mean HB will calculate backwards to July 2014 and there is potentially an over payment of HB ????? nightmare nightmare nightmare !!

Sorry, I was up early today (for me) and I was reading your post literally and couldn't make the numbers add up.

Basically they are saying that as the calculated ESA(IR) is less than 2 x ESA(CB) SG (£208.25 vs 2 x £109.30) the ESA(IR) is not payable.

We don't really deal with Housing Benefit, but as I understand it the Disability Premium and the WRAG or SG component are mutually exclusive so you would not see any significant change.

Doing a search for "housing benefit calculator" shows that a number of councils have calculators on their sites which you may be able to use to see whether you are still entitled.

Yes, I'm afraid this is a possibility, as an alternative to one of the calculators you might want to try and get face to face advice, do an internet search for "welfare advice" with your postcode, town or county.

Thanks Gordon , I too was up early , due for surgery at 11am, op cancelled at 9am. so i got faffing with the dwp.

Yes , that is exactly what they are saying . I went on our councils website , ticked all the boxes , and it makes the applicable amount to £225.60.
from that I think the disability premium is added. Anyways , i will double check. I also resent my change of circs to HB , asking them to get a move on , to avoid an over payment. my first cocs was sent 1 june.

from this news today , i have got a health costs form from the hospital . so will apply. Op now scheduled for 28th june. sailing very close to PIP tribunal date of 10th July eeeekkk.
