The JCP staff member who helped me said that WCA sanctions/found well enough to work have increased lately. He's personall dealt with three that day. Don't forget to copy The Tribunal Service in on the fresh evidence as well, in case DWP do not concede without "putting up a struggle" !!

Update,

I've managed to get my form in to the tribunal just in time, used the guides and the legal stuff, added a supporting statement, tackled the madatory letter paragraph by paragraph, added all the medical evidence and written to DWP to tell them the appeal is submitted. My cough is back to what it was when I first caught the whooping cough and I'm having panic attacks again. I haven't slept properly for weeks and didn't sleep at all the lalst two nights. I'm starting to consider that this is harrassment of a sick person.

Update:

Its almost a week since I submitted my appeal and sent the DWP, by e-mail from the JCP Lewisham.

Today the DWP rang at 9.40am to tell me they'd received my letter but as the tribunal had not officially received notification of my appeal from the Tribunal, they are unable to reinstate my payments until they get this notification so why don't I ring them and ask them to hurry up!

Update,

I rang the DWP today (7th August) and they have no record yet of the tribunal notification. But they did tell me something I haven't seen on here and it might be useful to others, the DWP are not under obligation to chase a tribunal submission until 28 days after the submission was made. Nor are they obliged to pay before that date either.

The important bit is unless you write to them and tell them you have submitted an appeal, that 28 days does not exist - for the person without money this might be a crucial stage to get lost in and for those without support or serious mental illness, this is a flashpoint for a crisis.

I have not had a payment since 20th July. My sister has been giving me food to keep me and my children going. others might not be so lucky.

I rang the tribunal and they sent a letter to the DWP on 28th August.

Rang the DWP back and they said it might take 7 days from the receipt of the letter before it appears on the system and any sort of payment is triggered.

The woman also said I'd get payments backdated because I hadn't claimed a anything else. Makes no difference to my payments, but it might to those who get more than JSA usually, as it says in the B&W guides.

Will let all know if I find anything else out and when I get payment for the records xxx
