Spookily despite my over the telephone request for SAR I have recieved a letter from the data protetion officer at DWP with a form to complete confirming my request with just a 20 day completon period, they have 40 days to send the info! But thanks I shall certainly complete asap with the suggested foot note all documention.pertaining ....

HI,

I have just recieved a letter from the DWP confirming my request for computer and clerical printouts however are they being sneaky as I made the request verbally over the phone on 24th June then they wrote with a form to complete ,then they write to say they have recieved the completed form and now have 40 days to provide data with a letter dated 17th July and request recieved on 14th July.?

Hi MM,

The 40 calendar days to comply from the date of receipt of your written request (SAR) is a maximum.

You may well receive the requested documentation earlier than that.

HI,

I have now recieved my SAR request, PA4 Medical Report, DPA Print out, DWP Bundle including appeal response and am working my way through it all for the claimant!!

I have noticed that the PA1 Review File Note is not the claimants name and national insurance number , is this an error? or is this referring to the meber of DWP who reviewed the file?

I have alos noticed numerous gramatical errors including incorrect consultant hospital address, disputed descriptors not listed in DPA report and undisputed descriptors listed as disputed etc , the lsit goes on.

The comments made on the DPA report and medical report are also most derogatory and misleading , "phoned claimant and he was having a nap", I took the call from the DWP and explained he was resting as he always had to do midday and could he kindly call back.

I specifically requested notes made by DWP during mandatory phonecall but these seem to have been omitted or just basically reported on the DPA printout . The MR agreed that is was advisable to be guided and supervised whilst moving outside, roads etc but no mention of this!

Finnally I see he is sensitivity 1 on report can you advise what this means and also noted special caution also stated?

Sorry for the rant and rattle but this is such a fass,

You can query the claimant name and NI Number in case the information is referring to another claimant, as I have never known The DWP or Assessment Provider to provide the NI Number of one of their employees.

Unless the grammatical errors are so bad that the information is illegible, they would have little significance.

Again, you could query the incorrect Consultant/Hospital address, is this someone else's Consultant ?

Basically, if the whole report is of particularly poor quality, you could challenge that, but the main issue is to challenge any information that is pertinent to the claimant's limitations and descriptors where they should have scored points and have not, by posing counter arguments whilst referring to any medical evidence that the claimants provided.

Again, you may consider this to be "most derogatory and misleading" but is it relevant to the claimant scoring points where they have not, but should have ? !!

Most phone calls with DWP are recorded, so you could make a SAR for recordings of the conversations, giving dates and times.

I am sorry, but I have not come across the term "sensitive 1" before !

In summing up, try not to get bogged down with the detail, no matter how annoying it may be.

It is import that you reiterate how and why the claimant scores the appropriate level of points under the applicable Descriptor/s of the PIP Activities that apply to the claimant.

Thanks as always Bro58 for your assistance.
I have made a direct request with the SAR team via the phone yesterday for the telephone call recording of the MR phonecall, however he is going to get back to me as he understands that incoming calls to the DWP are recorded but not sure about outgoing calls made by DWP team to claimants ?

I understand where you are coming from with not to get too bogged down with all the detail and will overlook gramatical errors etc for now.

Just wishing to clarify when completing the written submission and you are looking at disputed and undisputed scores do you refer to points awarded by the DWP at their final DWP appeal repsonse as they have changed throughout original claim, MR Claim and Appeal Response?
