A letter from the practitioner that is to perform the Spiritual Healing, maybe, I am not sure ?

A letter from your G.P. ?

It is whether The DWP would recognise this as "receiving treatment for your medical conditions"

The ESA 4 weeks rule is rigid unless you can prove the above.

I can't really suggest anything else, maybe The CAB or the like could help ?

Absence to receive medical treatment is covered under : ESA Regulation 153 (2008)

Looking at the conditions to fulfil ESA Reg 153 they seem pretty rigid and you would need to convince DWP that you were abiding by those conditions.

This subject is covered under : ESA Regs CHAPTER 3 Temporary absence from Great Britain.

Sorry that we can't really advise any further on this issue !

Please be aware that if DWP do close your ESA Claim it could cause you major problems with reclaiming ESA again !!

Do you think a GP letter and my mental health doctor does a letter will that help ? GP has said I need change of scenery many times as it might help also GP letter got me into support group with ESA my doctor knows I've been through a lot as I'm young I'm in this Situation cause of previous GP and SURGEON

We have no prior experience of this issue.

I am afraid that only the DWP can decide whether your 5 week trip abroad will be classed as :

"Absence to receive medical treatment" as covered by The ESA Legislation.

Is there any way that DWP could check if you are abroad for more than 28 days? I know with PIP that you can be abroad for up to 13 weeks as long as you inform them, but again, would they know? ( unless anyone maliciously informed them)

Hi Kk,

This is a question that has been asked here and on many other forums.

We don't know how The DWP may find out if you went abroad if you did not inform them.

There is the chance that they may gain information from you using your Passport, etc, etc ???

All that we can do is inform members of the "rules" and what they are "supposed" to do !

Actually, with ESA a claimant is supposed to inform The DWP if they are going to be away from home for more than a day !!

As confirmed at ESA Regulation 157. (d) (2008)

"Disqualification for misconduct etc.

157. (d) is, without good cause, absent from the claimant’s place of residence without leaving word with the Secretary of State where the claimant may be found."
