Someone please help....

Firstly a quick run-down of my situation.

I've been suffering with Chronic Fatigue since a bout of Encephalitis in 2006. This is coupled with serious depression and anxiety. I have very much reduced feeling in my right forearm and hand(right dominant), 50% damage as confirmed by conductivity testing.

I have been on ESA(contribution based then Inc based) since transferring from IB.
I have had issues with cramping in my legs preventing me from walking any distance without pain. (This was initially put down to Fatigue, Physio at the time gave the standard advice re Pacing.)
As a result of increasing activity I and trying to improve my situation other symptoms became apparent(3 visits to A&E). Initially told by multiple Medics it was probably CRPS, not the normal Hot version but the much rarer Cold variety.

Had official DX of CRPS in the beginning of Dec last year and immediately began a claim for PIP. Then told it wasn't CRPS but I had blocked (one full, one partial) Femoral Arteries which was causing Neuropathic pain I am due for double bypass next Monday.

Claim for PIP. I had my assesment (Capita) at home- just so happened that it was the morning when my symptoms were at a minimum- I made this abundantly clear to the assessor.

Pip was denied , I was given 4 and 5 points. I requested a Reconsideration and sent evidence from Consultants, GP, Mental Health, Specialist Physio(Pain Man), This was sent Special Delivery/Next Day to be in before the deadline(which had been extended by me already). Receipt shows delivered in time. Reconsideration was actioned but again was denied- due to not submitting evidence! Requested a second reconsideration in light of this, which was granted. I resent the documents from the first and submitted further evidence(around 30 pages of), again Special/Next Day- shows received.

Awaits letter, which duly arrived on Friday, Denied- AGAIN. No further evidence received!!!
What happened to all the evidence I sent? It wasn't reconsidered at all, they had just sent me a copy letter from the first reconsideration back in May.

Wolverhampton scanning centre seem to have taken multiple weeks to scan these, effectively screwing me and likely many others too.


I am about to loose the plot entirely. I know I am going to have to make a Tribunal claim and desperately need some help/guidance.

In regard an appeal have a look at our PIP Appeal guide which has links to the form you will need to complete and instructions on how to complete it.

You don't mention having requested the assessment report, whilst this will be in the DWP submission to the Tribunal, you might want to request it now if you do not currently have a copy, just ring the PIP office that dealt with your claim, I would follow up the request in writing.

You mention you are due an operation soon, is it possible that the Decision Maker does not believe you will meet the PIP forward test (9 months)?

Thank you Gordon. I have the Appeal guide and am working through it.
I haven't got a copy of the assessors report, but will request one.

My claim dates from 01/12/14 so the 9 months forward test should only cover until August this year as far as I see it?

I haven't spoken to a Decision maker but to request extensions to deadlines- never to discuss/explain the decision on my non-qualification for PIP. They have made a decision without seeing anything other than the initial application- and Assessors report.
They have not taken into account my additional evidence,around 35 pages of it.

My GP has signed me off for four months from July this year with regard to blocked arteries.Due to this I have a very short Claudication distance and in pain when at rest. I also have long-standing Fatigue. Recovery from double femoral bypass is an unknown. I'm still likely to be symptomatic. Due Psych assesment via Pain Management.

I'm already getting ESA (WRAG-LCW)

Right, that's the Assessors report requested and my MP emailed.

Hoping that he can stir them up a little, to at least give me a fair hearing.

Wheels are turning at DWP!

I have just had a rather long phone call with a Decision Maker, she was profusely apologetic for DWP/PIP, the delays and not using evidence that was provided by me - twice.

Finally some progress., though it's not over yet.

I should have a decision within a month, properly reconsidered this time!

Feeling a little better :-)
