With regards an ongoing claim I am questioning the DM stating medical opinion which I wish to contest and have established that the medical opinion within their own guide appears not to have been used, the information within the guide is correct and supports my claim.

Any experience of DWP not using their own guides? I am agast at how many possible errors have been made..................

Do you mean the following

www.gov.uk/government/publications/medic...lt-cases-staff-guide

You don't say which benefit this is in connection with!

If DLA or AA then the information is guidance only and is not binding on the Decision Maker although they will have to justify their not following it.

If it is for PIP then as we understand it, this document is not in use.

Hello Gordon

Sorry should have said, the benefit in question was DLA, does that help in any way?

Thanks

Sorry Gordon should have said yes that is the guide, the details of my particular condition are well covered within the guide by a leading specialist but in a Decision Notice last year they have thrown in some other medical evidence from the web which I know is not accurate, it appear they have favoured medical evidence that supports their decision rather than my condition, as is included in THEIR guide!

There is no reason why you cannot argue this point.
