Sorry to ask but does that mean they take my other money into account, becouse the only other money I receive at the momment is income support and dla, im aware I will loose my income support if im successful in getting esa but worried that becouse if I get contributory esa it will affect my money as I have a freind who was working and now on esa and hes on c esa and dosnt get much. Many thanks

Your Income Support will be replaced by an ESA(IR) top up depending on your circumstances, I believe that SDA is less than ESA so this may also be a factor. There is also a guarantee that your ESA payments will not be less than you were receiving under SDA and IS, if they are then you will receive a Transitional Payment to make up the difference,

Your DLA is not effected by the other benefits you receive so the payments will remain as they are.

Hi, I've been to cab today and they have told me the same as you that because I'm on Sda if I am lucky enough to be transferred onto esa I will probably be put on contrubary esa for 12 months then it will stop. But they also told me I would not be able to claim again for 12 weeks and if I did I would only get contrubary esa again really confused and worried now :dry:.

I'm afraid what they have told you is wrong, they haven't even answered right question!

If transferred successfully you will receive either

- ESA(CB) on it's own, or
- ESA(CB) with an ESA(IR) top up.

Which it is will depend on your personal circumstances at the time and which group you are in.

If you are placed in the Support Group then you are more likely to get ESA(CB) with an ESA(IR) top up although I can't guarantee this. While you are in the SG your ESA(CB) will remain in payment as long as you continue to meet the criteria for an SG award. If you were moved to the WRAG then you will still have 365 days of ESA(CB) payments (see below).

If you are placed in the WRAG when transferred then your ESA(CB) will only be payable for 365 days, if your payments include an ESA(IR) top up then you will not need to do anything at the end of the 365 days as your ESA(IR) will be increased automatically to take account of the ESA(CB) being stopped.

If you do not get an ESA(IR) top up then towards the end of the 365 days you should be assessed for ESA(IR) (you may need to chase the DWP for this). Based on the fact that you currently receive Income Support and providing that your circumstances do not change significantly in the interim, then there should be no reason why you should not be moved onto ESA(IR) at the end of the 365 days, this will not be less than you were receiving on just the ESA(CB).

I know all of this sounds complicated, but based on the information that you have posted I cannot see you being worse off than you currently are under SDA/IS.

Thank you Gordon, will have to wait and see, one last question if you don't mind I've had the letter explaining about esa and they will ring me, and if I havnt heard anythin after about 14 days to ring them so my question is does the questionair come before or after they ring me, also will I receive the questonair as ive heard many people aren't getting there forms from maximus and closing down there claims. Thanks

Hi b72,

I think that you are listening to too much "Hearsay" !! :) and as Gordon says The CAB told you a load of rubbish !!

Read through the information in our FAQ's accessible by left clicking your mouse/pad on the blue links in This Post.

You will find that if you read through our guidance, it will save you asking a lot of questions ! :)

You should first receive the "courtesy phone call" which is really of no significance other than telling you "what" to expect in the transfer process.

You don't even have to answer it if you don't want to.

Between 7-14 days later you should receive The ESA50 through the post.

Even though the title of it is "Being transferred from incapacity benefit to employment and support allowance" it also covers SDA and IS, i.e. the process is the same.

There was a short period where we heard from some members who were current ESA recipients and they were receiving an appointment for a face to face assessment to be re-assessed without first being given the opportunity to fill in an ESA50, but they were already receiving ESA.

If you are concerned, you can give it a week or so after the phone call, then if you haven't received The ESA50 through the post, you can ring ESA :
