Hello

im not sure what to ask on the forum so please forgive me if the question's have been asked already.

I have been in receipt of DLA Higher rate for 23 years since leaving HM Forces. In the period i have have undergone a total ileostomy operation 7 yrs ago ( non Reversible).
I have asked the DWP if they could send me a copies of all the medical notes they currently hold about my condition.
They have told me that they have no information on record about my DLA Condition or My ileostomy.
Could somebody please advise me on the best way to approach my application for PIP.

Hi Robin

First of all, your full name is showing; if you want to amend this, please look at the 'frequently asked questions' and it will explain to you how you can change this.

As for your medical records; if the DWP can't help you, you are able to access your medical records from your GP; it might cost you, however. You are entitled to look through your records and select the files/records which relate to the condition you are claiming for - you clearly must have had issues which have led to the ileostomy. You can request copies of the appropriate files, - and as I say I am pretty sure you will have to pay for them. Be selective and only choose the files which are concise, very clearly explanatory and supportive of your claim.

You could also ask your GP to provide you with a supportive letter - obviously more recent medical documents are going to be more useful than historical records.

As for the way to approach your PIP application; first of all, read through the guides on the website. Look through the descriptors and decide which ones apply to you, and gather together the evidence from your medical records which will support your claim. When you fill the form in, don't just 'tick' boxes; always give examples of how your disability affects you, and how often it causes you pain/discomfort etc.Keep a diary showing how frequently you have 'good' and 'bad' days; ask a friend or a relative who knows you well to write a letter in support of your claim, showing how your illness affects your day to day life.

Hello shelam

I'm not sure what to do your help would be appreciated.
I have been told over the telephone today that my pip has been decided,
I have been awarded standard rate of care only & my DLA higher rate has ceased.
I no longer get the mobility rate. I have spoken to my doctor who informs me he has NOT been contacted by anybody to didcuss my medical condition, I'm just curious as to see if I can appeal this decision as I have in receipt of DLA Higher Rate for 24 years since leaving HM Forces.

Whilst I'm not suggesting that you do not meet the criteria for an Enhanced award of PIP Daily Living, it's really important that you understand that the criteria for this is fundamentally different from that for DLA.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process and template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Don't delay getting your Mandatory Reconsideration request submitted if the assessment report has not arrived in time! You don't need to go into much detail initially.
