The first thing you need to do is to request an appeal this is done using an SSCS1 form, there is a link to this in the PIP Appeal guide and instructions on how to complete the form, you need to explain why you are requesting the appeal but do not have to go into detail at this time.

Once your appeal is accepted the DWP will prepare and submit their evidence to the Tribunal, you'll receive this and can then make your own submission.

Pick your battles, remember an award will only be made by you showing that you meet the criteria so concentrate on this first, make sure that you deal with all of the elements in the Descriptors that you hope to score points for. Next deal with the issue in the assessment report and the DM's comments that directly relate to those Descriptors, you don't have to argue all of them, choose the ones that you think have the most negative aspect to you claim.

Thanks Gordon. I have just been looking at the sample submissions in the PIP appeals guide, and wondering if I need to do this now or not.

So I can just request the appeal now and then do a detailed submission after the DWP has submitted their evidence? There will be a chance to submit more detailed information then? Just to check I have got that correctly.

Do you think there is any point in me including my previous letter of award, where i was awarded enhanced rate, along with the appeal request to show the changes? or would this not be appropriate as they would already have the info? Thanks

Yes that's how it works, I would start preparing now, but not submit anything until you see everything that the DWP used to make the Decision.

The Tribunal will only have what is sent to them as evidence so this would not normally include any information from a previous assessment, so if you think that this information helps this claim then you can include it, but you need to explain why it is relevant, don't assume that the panel will make their own connections between the reports.

Also you need to place the old report in terms of how your conditions and limitations have changed since it was done, this may simply be a case of saying "I'm worse" but again, don't assume that the panel will understand this on their own.

OK thanks, I've simply said I have the same conditions and still need the support for now and that the reason for appeal is my enhanced rate care award has been withdrawn at reassessment. I can just put (see enclosed award) I suppose
