I have just been informed by DWP that my ESA benefit has been stopped, I was in the group that did not have to seek work. I have requested a SOR. My question is that the DWP has stated that I did not attend two medicals, I require a home visit, this was explained and a visit arranged. This did not take place as I was ill at the time, I then heard nothing from DWP for 6 months and was still being paid. 3 weeks ago when they made me another appointment at the medical assessment centre. I informed them of my condition and that I would not be attending. There are aware of my condition so why send these assessment centre appointments out. It was a week later that they have decided that I am fit for work, my money stopped and my P45 returned. I sent them medical evidence at the time, I will be appealing this via Mandatory Reconsideration. My question is: DWP have stated in their letter that if I require a home visit I need to send in a Dr’s letter to the centre asap. Why would this be stated if they are not paying me anymore, and should I apply for a home visit or send the letter to DWP as part of my appeal?

I am sorry that you are going through this :(

You have been found 'fit for work' on a technicality because you have failed to attend 2 appointments for assessment. The people who make the appointments have no access to your form and do not know that you have requested a domiciliary appointment! Yes, I know - it's ridiculous isn't it?! :angry:

The Mandatory Reconsideration will look solely at whether you had 'good cause' for not attending, it will not look at whether you are entitled to the main stage of ESA. If DWP have asked you to submit a Dr's letter as soon as possible then, in your position, I would do so! It is not usual for them to change their minds without the MR but I wouldn't want to throw a spanner in the works if they were considering it. Make sure you keep a copy so that you can use it for the MR if needed. I suggest you continue with that process until/unless you are told otherwise by DWP.
