Currently the mobility element of our claim has been refused, despite very obvious mobility problems due to a stroke - my question is I am about to launch an appeal, within the time scale, but I have heard from my local garage that they have been told the mobility allowance has been withdrawn and they are therefore coming to collect the car next week - this will leave us unable to get out. Surely if there is an appeal in process this should be stalled until the outcome of the appeal. Has anyone had experience of this or any information to share?

I am afraid that your garage is correct. Once your mobility award has ended your car has to be returned. I believe Motability used to let the car stay until the appeal had been decided. However they no longer do so, possibly because things now take very much longer.

Of course, you have nothing to lose by contacting Motability and pleading your case, but I don't hold out much hope.

If you have been a Motability customer for some years (since before the introduction of PIP was announced) you should receive a cash payment which will go a little way towards the purchase of another vehicle.

Please make full use of our PIP guide for your Mandatory Reconsideration (if you have not been through that process) and appeal.
