I'm sorry but Decision times appear to still be extending.

Hi. Well I have received my long awaited brown envelope on Tus day this week. DWP had solely taken notice of the ATOS assesment. Not on the consultants outpatients my occupational health ect ect ect evidence. I was awarded the standard for the care. I had a read through the award and also had my daughter read through and the reasons the DWP had allocated the points and know I can provide further evidence to show ATOS had not looked at my situation and the assesment the ATOS person did did no way reflect on my case. I immediately rang up and said I wanted a mandatory reconsideration the call handler said I would receive a call from the case manager within a week , next morning at 8.15 I got a call. Firstly I felt the case manager tried to put me off even before I had spoke to her. She said I must warn you that if you ask for a mandatory reconsideration you could loose all the benefit j u St awarded. She asked me what part I didn't agree with through my tears and anxiety attack I managed to explain very loosely about how the ATOS assessor had not done any examination o myself and how he had put in his report that I had not got depression and anxiety when I had provided them with evidence fron my occupation health and provided them with my social worker. CMHT nurse and recovery worker details also my GP re other issues as well as anxiety and depression . The case manager said she will take another look after I had exp l ained everything she also suggested I get letters from all my consultants and care workers and GP as she said the onus is on me to provide that direct evidence even though I had sent them all my hospital letters occupational health letter re surgery letters ect ect. I then got a text message from the DWP saying my claim was been re looked in to and I had no need to contact the DWP again and the will be in contact ....
so my question is. ..
Is this a mandatory reconsideration she is doing, or is she re looking into the application again. Do I need to request letters from all my care givers as she originally said. I'm confused should I write in saying I had requested a mandatory reconsideration via phone and state the reasons again. Then if I have to go further then ask for all the specialist input I will have to pay for a GP letter I am now on half p ay so struggling to pay my rent and household bills. I don't know if I can claim any benefits because I am in full time employment but been on long term sick for 6 months I don't have any savings so at the minute I feel like I sinking and cannot do anything to help myself. Any help and assistance would really be appreciated. Thank you sue

Sue

It's our recommendation that MR request are made in writing, it's all to easy for a request made over the phone to be lost or misinterpreted. The request should be arrive at the DWP no later than one month after the date of the Decision.

You can either include your reasons for the request with the MR letter or tell them that you will be sending in more information later, you should be given four week to do this, but sooner is better than later.

As to new evidence, can you provide any that is of value? If you can (within the timescales) then it can only help your MR.

If your GP has certified you as Unfit for Work and you have exhausted your SSP, then you can make a claim for ESA, see our guides for more information.

The timescale varies hugely I'm afraid. We have heard anything from 2 weeks to the best part of 3 months!
