Just read the news about the going out with mental health problems I was awarded the 4points for this I have always maintained that I have to be accompanied leaving my home and for the duration of the journey because of overwhelming anxiety and distress (which has always been ignored) I am in the middle of completing my AR1 form which I have ticked no change but I have ticked harder to the moving around question because my mobility has detereated I have also written on a separate sheet why I have also mentioned there has been no change in my mental health and also still not being able to go out on my own so when they receive my form will this be looked again and other points given or should I make a reference to this on the form thanks in advance ALSO Steve I'd like to thank you and all the moderators for your hard work even if you didn't get a mention !

This UTT Decision only effects (d) and (f) for the Going Out activity and opens the door for a claimant to argue that their mental health issues effect them so greatly that their cognitive functions are impacted on to the extent that it would prevent them following (navigating) a journey.

So if yo are to score for these Descriptors then you need to explain why the above is the case.

Can I ask I've just read your information regarding the AR1 FORM it says it goes to a case manager and that they look at your originsl pip form but if like me you were awarded no points but then win your appeal to get an award would they have the decision paper work to look at to compare what was said and what information you have given on the AR1 thank you

I would expect this to be a case where a new PIP2 will be issued rather than an AR1.

Sorry gordon im a bit confused if the case manger looks at the AR1 and the extra evidence I have sent with it if they have got to look at the original pip form (I had no points for daily living 4points for the following a journey) then i appealed and was awarded higher rate care would they have a copy of the appeal decision to compare the information I have put on the AR1 sorry maybe me not reading your reply correctly thank you

Sorry I thought you were talking about a future assessment, my bad!

They will have a copy of the Decision Letter from the appeal but this does not really present any detailed information as to how they came to their Decision.

There are three issues you need to consider although they are all tied together;

The assessor and Claims / Decision Manager having access to all of the information used in the making of the original and the Tribunal's Decision.

Even if they have all of the information they may be selective in using it, if only the PIP2 is presented it may provide an incomplete or erroneous picture of your problems that led to the current award.

And of course as always, there is always the issue of their actually using any of the information from your previous assessment and the Tribunal.

I think this is a case where you need to consider including your own evidence, even if it is information that you have previously sent to the DWP, so that you can link to it in your answers on the AR1 and perhaps treat this form more like a PIP2 than an AR1.
