The same thing happened to me. I had a date for the Tribunal 2 days before DWP phoned and offered me High Care Low mobility which is what we had in mind asking the Tribunal for. So I have gone from no award to this.
Thanks to ATOS HP lies this took over 6 months and a hell of a lot of stress. We will now be opening a case with the Government Case Examiner against ATOS
My questions are do the DWP check your file before the tribunal date and look to see if it is winnable?
Is it worth opening a case against ATOS or is the Case Examiner part of the ATOS cover up?

Have you made a formal complaint to ATOS? You cannot involve the Independent Case Examiner until you have exhausted ATOS's own complaint processes.

Yes I have made the complaint to ATOS (in December) they told me that the Assessment was not fit for purpose and this particular HP has had many complaints made against her(off the record)I am still trying to get the final response from them.

If they have said this then I am not sure what value there is in you escalating the complaint to the ICE, this is done when you have not received a satisfactory result from the original complaint.
