hi all at baw, i have been waiting to hear about an appeal i put in to go from wrag to support group. i have not heard anything for a few months now. i understand theres a backlog but i was at my diabetic review today and the nurse informed me that because of the diabetes and, or nerve disease that i have, she could not detect any pulses in my feet, and because of this i am very high risk of losing them. i have to go back next week again but this is to see a podiatrist. i am wondering if its worth mentioning this when i have my appeal, or whether they will not take any notice with me only getting the news today. i did mention on the esa claim form that i had problems with my feet. benefits and work are handling my appeal for me and i am waiting to hear from them

Hi b,

The Tribunal will only consider any fresh evidence that was pertinent at the time of the adverse WRAG award.

Therefore, any new evidence that you may obtain must be tied to the limitations suffered as a result of your medical conditions at that time.

The Tribunal will not consider any deterioration or change in your conditions since the time of The WRAG award.

my nurse at diabetic review told me today i am very high risk of losing both my feet because there are no pulses in them. im still waiting to hear appeal date to go from wrag to support group for several disabilities, benefit answers are handling this for me and they have heard nothing yet. it has been a few months now but the dwp have told me that i will be on esa ir when my esa cb runs out in july. im wondering if i mention this news from the nurse today to the tribunal will the tribunal take notice of it. they know theres a problem from my claim for esa last year, but things with my feet have gone downhill since. do you think i should mention to benefit answers and see what they advise

Hi b,

Yes, you should update the adviser with regards to any new developments.
