I have been dreading the "brown envelope" coming through the letterbox, after fighting, and losing to get into the support group last time, i was dreading the decision this time, going through the trauma of appeal etc to be told you are in the wrag and must attend back to work meetings. This, for me is very hard, as there is no local "bootstrap" office near me, i have to get someone to drop me off at the office and wait to pick me up, Lo and behold it arrived this morning and.............i am in the support group without having to have another medical!! thank you benefits & work for the help in fiiling out the dreaded form!. I cannot hold a pen long enough to complete said form and filled it in on line using your guide lines this time, giving all the info i needed to put and elaborating on my condition. I used a further two pages describing my day to day problems, leaving nothing out and the relief of getting a correct decision without said medical is overwhelming. THANK YOU from the bottom of my heart and keep up the good work

Hi Jimginn,

That is great news! Thanks for letting us know and for your kind words about B+W. If you wish to have an idea of when to expect reassessment you need to contact DWP. You can phone and ask for the 'prognosis' (time until reassessment), you can write and ask for a copy of the ESA85a or you can write and submit a formal 'Subject Access Request' which should give you a copy of all the paperwork that DWP have in association with your claim.

Thanks also for letting us know, as good news stories can only give other viewing members hope of a successful outcome.

If you wish to know the recommended length of the SG award before reassessment (The Prognosis), you can ring the 0845 number on the decision notice letter, they should have on-screen.

You could also request The ESA85A Medical Report whilst on the phone, but it may also be advisable to back up this verbal request in writing.

There should also be an LT54 Form and there may be an ESA113 if one was issued to your G.P.

To cover all bases, you could request "all" documentation used in coming to the SG decision.

To be sure you could request the above, and then make particular written requests for :

1. Reasons why you were placed into the SG at reconsideration, including which of SG descriptors were applied. Whether it be one or more of The Schedule 3 Functional Descriptors, or The ESA Regulation 35 Non Functional Descriptor.

2. The prognosis of the SG award, and when you should expect to have your next reassessment.

You can do this using a SAR Form :

Or you can make the request in the form of a letter, as long as you make it clear that you are making a formal SAR under The Data Protection Act 1998.

Address the envelope : FAO The Data Controller, at the Benefits Office dealing with your ESA.

Write DPA 1998 SAR in front, top, left corner of envelope.

Once received, they have 40 calendar days to comply.

Sending Documents to the DWP or ATOS

The above information may be helpful at the time of your next reassessment.
