This course examines key case law relating to the following disability-related qualifying conditions for DLA and Attendance Allowance:
- attention with bodily functions and continual supervision
- the cooking test
- day and night-time needs
- intermittent conditions and obviating needs
- unable/virtually unable to walk
- guidance/supervision - unfamiliar routes
- children and the substantially in excess test
The course is aimed at those seeking to improve their knowledge of the law surrounding DLA/AA. The information provided will be useful to those assisting with claims, revisions (and supersessions) and/or appeals work.

This course is aimed at representatives and advisers who wish to gain an understanding of the rules and case law surrounding evidential matters at appeal and the powers available to a tribunal to enquire into and remove an un-appealed component (e.g. tribunal remove mobility component when only entitlement to the care component was in dispute).

- what may constitute evidence, the evidence threshold and burden of proof
- treatment of claimant and representative evidence

- tribunal’s own observations

Part Two: Defending the Un-appealed Component
- tribunals (and decision-makers) - rules on appeals (revisions and supersessions)

About MNP Training
All MNP Training courses are delivered by Mark Perlic. Mark has been a welfare rights practitioner since 1984 during which time he has worked as a manager, trainer and caseworker. Mark is the author of Derbyshire County Council's DLA and AA Case Law Pack which provides a digest of key House of Lords, Court of Appeal judgments and Upper Tribunal Judge/Commissioner decisions. The Case Law Pack has proven hugely popular, selling to a variety of bodies including generalist and second tier agencies. It has established itself as a valuable resource to welfare rights advisers across the country.
Mark currently works for Wolverhampton City Council's Welfare Rights Service as a Senior Welfare Rights Officer, where he manages the ‘Take-up Team' responsible for benefit maximisation work amongst vulnerable people in the city. Before joining Wolverhampton WRS Mark worked for Birmingham Tribunal Unit (BTU) as their Training Officer. Whilst at BTU he was responsible for designing and delivering the Unit's welfare benefits training program.
Mark is a registered Continuing Professional Development presenter and is an affiliated member of the CPD certification service.
