PIP decision after telephone assessment

Just received my letter stating that am not entitled to PIP. Still in shock. I will be asking for DWP to reconsider the decision. It seems that the health professional did not listen to what told them e.g. i can wash unaided. I was clear that i required my wife support to shower daily, firstly as it was not safe for me to do this on my own, secondly it is too painful for me to use my right arm, and i need to use my left arm to hold onto the windowsill as i was at risk of falling in the shower.

Any advice is welcomed

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Hi i have received & read the HP report, i am shocked that it resembles/reflects so little of the tel assessment e.g. the claimant did not report any significant functional problems ....
I recorded the assessment & clearly described i can't prep food or cook safely due to pain & weakness in right arm. the report is similar throughout.
so frustrating . i will request mandatory reconsideration focus on how i meet the criteria.
should i complain about the report or is this a waste of time/energy.

The point of you submitting the MR is to try and get the decision over-turned, so it's important that you concentrate on the areas where you didn't score points and you think you should have done, and in doing so you will be challenging some of the things that were said that were inaccurate or were not included. In terms of the overall quality of the report, you could always use the final paragraph to say what the main issues were and how disappointed you were.

If you want to put in a formal complaint about the quality of the report, this is dealt with separately from the MR. People often ask if there is any point. All I can tell you is that many find the complaints lead to nothing, but we have had some on this forum, where a complaint has had a positive outcome. Only you can decide what is right for you. Your complaint about the assessment needs to be made to the DWP.

Hi, issues i am picking up from the report.


As previously describes the report resembles little information provided in my telephone assessment and in my original application for PIP.

The health professional in my view does not understand the impact of dyslexia and dyspraxia on my daily functioning.

The health professional states that dyspraxia and dyslexia or not disabilities.

There seems to be contradictions in the report for example in the beginning of the report the health professional states that I need support with taking my medication at least four days a week. Professional states

In the descriptor the assessor states that I meet the descriptor a medication or therapy unaided.

i will be the DWP tomorrow to request a reconsideration

any advice please

Hi PCB110

As said before you need to concentrate on the areas that you didn't score points and you think you should have done. You need to show again, where your dyslexia and dyspraxia have an impact on your daily functioning along with any other conditions that you have and quote from any medical evidence that you have from professionals.

If you didn't before, you can always include a letter from your wife, talking about the support she has to give you, making sure that it is relevant to the PIP criteria.
