If you do an MR and they give you standard rate, can you still get that amount while you appeal for enhanced? Thanks

Yes, if the Decision is revised at the MR then that award will remain in payment if you then make an appeal.

Thanks. What we found last time was that the paper appeal seemed to look at things afresh and gave points we didn't ask for which were more support...seemed to go by my care plan and medical stuff more than what we said. So think will just do a basic MR for now as find it too stressful going into too much detail on some of my problems. and just refer to the info sent in.

It's pretty obvious they haven't looked at the info, as now they asked for the supplementary info, the assessor has come back with 'if I was aware that they had specialist support..' but then staying they wouldn't have given more points anyway! But if they had read by medical reports properly this wouldn't have been a problem.

Anyway. So, if for now we just ask for standard rate and give reasons for that, would there be a problem at a later stage with appeal I wonder. Last time I think we just said here is the information, they have withdrawn the enhanced rate and didn't ask for a particular rate at appeal. But would it be a problem if have said at MR think should be standard? I am just thinking it is unlikely for MR to result in an enhanced award as it is, but may get me a standard one so don't have the stress of an appeal

OB

If I understand what you are suggesting then asking for the Standard rate now is going to undermine your asking for the Enhanced rate later.

Just go back through your PIP2 and the assessment report and explain why you should score the points you reasonable think you should for each activity, leave it to the DM to decide whether they revise the award or not.

Oh dear, just seen a similar situation where the appeals simply reinstated the decision but just to the end of the award, and the person had to reapply as it was only a month or so. Not good. Hope can avoid that.

Got the letter today and was very strange, has no reasons really on it. Just a weird sentence about something which makes no sense. Wonder if they can just say I have decided but no reason why. Well at least have the report and we have sent a more detailed MR in now so just need to wait and see. I really don't trust them, and will kind of be a relief to move on from their dodgy ways to the tribunals service in a way.
