Yes, a Decision can be challenged up to 13 months after it is made, however, after a month the request becomes Late and the claimant needs to provide Good Cause for this if this is not accepted then the request can be refused.

Yes we/I agree with you, we would accept the enhanced daily and standard mobility as this is what she has always had, I have rang DWP again today to ask why we have not been contacted with the news that the award has been increased to 19 points and ask mum how she would like to proceed.? The response from the first two people was “I don’t know! “ finally after a further two attempts the fifth person said that as there appears to be doubt about how the mobility affects my Mum as the PIP is there to help people manage the effects on their daily life due to their illness, the DM was unsure that just because Mum hasn’t got a medical condition with walking on the Other hand she has because she cannot manage without her medication, once medication has been taken she is then unable to walk very far and not without support from someone being with her?? So this appears to be the question ? Legally dose she have a walking issue? Mum mobility is effected every day as she has her medication daily and extra should she need to leave the house in which case she would always need someone with her. The only way she would be able to walk unaided and safety would be if she stopped taking all her medication. This is not an option.
The adviser said they couldn’t do anything now, because it was at appeal stage and I had nothing to loose by continuing as they had agreed to the increase in points for the panel but they need to have the panel decide on the Mobility issue.

To be honest they didn’t seem very sure of what they were saying to me, at all. so I don’t know what to do now ?

Should I ring DWP again tomorrow see if I get a different response? Or should I contact the court clerk?

I don't see why the Mobility is an issue if your mother is not pursuing appeal about that component. If she is then that is another matter.

I would ask for a call-back from a manager, the call centre staff can only take the issue so far.

Thank you for your reply I will try again tomorrow and ask for a manager call back as you mention.

Just on the Point re Moms mobility do you think it would be worth pursuing based on my Previous comments?

Obviously the easy option would be to take the DWP offer of having her enhanced daily reinstated, but then if you think the tide has turned or maybe the penny has dropped for the DWP then keeping the appeal ongoing maybe also be an option as having enhanced mobility would make a world of difference for mum as we could try and get her to leave the house in a safe space ie the car like we use too ??
Although Mum hasn’t left the house since her assessment in April.

Any advice or even just your opinion would be appreciated.

In previous posts you have indicated that your mother has significant problems with going out if this is the case then she cannot score higher for the Going Out activity so any increased Mobility award will be entirely dependant on your showing that she has problems with walking but you have said that she "hasn’t got a medical condition with walking" which suggests she cannot score for Moving Around.
