TOPIC: DLA TO PIP

We hope you can assist us it is regarding the transition from DLA to PIP. We requested a copy of the assessment report after had a home visit the end of October. We have a few questions before the final decision from DWP.
1: Can you ask for the time frame of the review to be reconsidered? Because the report says a one year review but G.P Letter says been no variability for many years.
2: Also is the review date from the date you telephoned them in July or from the home visit October?
3: Can your G.P do a letter before the decision is made? As could ask her to do one stating again been no variabiltiy for many years etc & what after effects had from home visit etc.
4: Do we await the decision from the DWP before disputing factors yourself within the report & the points scored etc & it contradicts itself saying you can't do something then another area you can do that movement etc? (or wait for the decision then ask for Mandatory Reconsideration)

1. First, the Decision Maker is not bound by the assessor's recommendation, they may decide that a longer award is justified. There is a window of time for you to write to the DM explaining why you think that a longer award is appropriate, the length of the award is supposed to reflect the likelihood of your conditions changing, for the better OR the worse, you are going to have to provide medical evidence that reasonably shows that a longer award is justified,

2. It's from the date that the Decision applies from, there will be a four week run-on of your DLA award.

4. As per (1), you can include any concerns about the report in any letter you write now, make it clear in the letter that you are not requesting an MR by sending the letter in, just in case it arrives after the Decision has been made. Concentrate on issues that lead to your scoring point, as an example; the assessor's spelling may be poor but it won't help you score, if you can avoid challenging the assessor's opinions directly it is better to undermine them by showing the facts they have based the opinion on are incorrect.

Thank you for your reply. So if the decision of entitlement over to pip is decided by the decision maker in february next year (because of current delays in pip process per your website) does the one year run from the february date? sorry just want to be sure taking in information correctly. So it is better for my G.P. to say my patient had a medical assessment but some information isn't factual because needs asssistance with all aspects of daily living and personal care upper and lower washing dressing undressing etc due to fatigue pain etc

No, it runs from the date that the Decision applies from.

If your GP Is willing to say this then yes, it will be helpful.

Thanks for replying think being stupid so does the 1 year run from phoning and starting process over to pip. Or when I get a letter with entitlement had assessment awaiting decision in writing now thank you for your time and patience

The Decision Letter will say when the Decision applies from and the award will run from this date.
