Well the dreaded brown envelope dropped on the floor this morning and my hands were shaking so much I could barely open it. To my relief I have been awarded standard rate for both daily living and mobility for 3 yrs with 8 points on each. I was previously on low rate for both with dla. Whilst I am ecstatic about the result I disagree with some of the findings but I feel to appeal it would be madness so I am happy to accept the result. Thanks to all for your help with the guides

With the help of my daughter we have gone through the dm reasoning and there are quite a few points I disagree with ie I have difficulty in communicating with people as to concentrate is very hard due to a head injury a few years ago and my memory can be bad at times. The assessor said my speech was intelligible and I had no difficulty in understanding what was said. During the assessment I had an extremely bad head tremor and I did everything I could to get through the interview. She also said I demonstrated cognition and memory suggesting I would be able to plan and follow journeys however this is incorrect and I cannot even cross the road by myself as I cannot move my head safely to the right. I struggle with lights and noise but she has disagreed with this. My point is that I struggle with many things on a daily basis and yet she has made a decision based on an hour of interview. Is it worth me phoning to speak to dm to go through it.

Only you can make this decision, the things you need to consider are how many points you got for Daily Living and Mobility and then how many additional points you might score by explaining your problems in more detail.

As an example, if you scored 8 points for Mobility and think you might score an additional 2 points by explaining your conditions further, then it is not worth your doing so as you will still not have sufficient points for an Enhanced award.

There is more scope for scoring extra points in the Daily Living component, there are more points available and they are graduated in smaller amounts than the two Mobility Descriptors.

If you think you can score sufficient points for an Enhanced award of one or both components then it is worth your speaking to the DM, it may be possible to do so without your requesting a Mandatory Reconsideration, but if not then you also need to consider how secure your existing award is before proceeding, as an MR opens the whole award to reconsideration.
