Can anyone please advise us.
My wife has a long term mental health problem since she was 16/17, she is now 47yrs.
She was awarded DLA for life, back in July 16 she went to a ATOS interview where they she was awarded 0 points, she went through the Mandatory & they said the same. We applied to the Tribunal & they wrote back & said there is a case & a tribunal will happen, this was in Nov/Dec 2016. Since then she has had 2 relapses & her doctor/ Psychiatrist has written a similar letter that they wrote to ATOS, they have also told the tribunal that in their opinion she should not have to go to another assessment as the last one with ATOS caused (in their opinion the latest breakdown. The tribunal agreed to a telephone interview where the Doctor & my Wife would talk to the panel, however on the day of the hearing we had an early phone call saying that the Judge was taken ill & the Tribunal would have to be reset. That was in January, we have phone up 3 times & told it is on the rota of the same Judge & we will have to be patient, the Doctor said its very difficult for the to make appointments & would like a definite date? Has anyone else ever had this sort of problem & how long did it take ?

Unfortunately Tribunal waiting times are extending as more claimants are turned down for benefits such as ESA and PIP.

You can try writing to the TS making them aware that your wife's health is deteriorating because of the wait and asking them to prioritise your claim, especially as one hearing has already been cancelled.

Please be aware, that the change in your wife's conditions cannot be considered as part of the appeal, they can only look at her health as it was at the time of the Decision being appealed.

We have been waiting an extraordinary length of time for the Telephone Tribunal Interview. So we have been told after waiting for this interview since January 17 that it will take place on December 21st, so next week we will finally have the interview, is this length of delay a record , a bad one at that...I hope so.

It all went well, they have granted the appeal & say it starts from 24/08/2016 - 23/08/2021.
Question I now have is, we are receiving Tax credits & when my wife lost her DLA we lost the NHS exemption tax credit card & we had to pay our prescriptions, which is a considerable amount between us. Can I ask the Tax credits to back pay us all the money we have spent on this as we were entitled from 24/08/2016 but only now have had tribunal ?

Many congratulations on the appeal success, well done.

It usually takes the DWP 5-8 weeks to process a Tribunal result, once your award is re-instated you can try contacting HMRC about the prescription costs, I'm afraid I don't know if you will be successful as this is not an area benefits that we deal with on the forum.
