What an awful hour I have just had going to my PIP face to face. I may be very wrong, but doubt it will be successful this time. I cannot ‘seizure’ to order. My Nurse, was hurriedly pushing me forward with no time to discuss at the end of my firm being completed. I was hurried out of the offices and close down was obvious.
Can I, rather than waiting the 4 to 8 week advised time frame, address this?
Will it do harm rather than good etc
I feel totally deflated and can not comprehend how a nurse can take on board the complex issues such as Epilepsy. I won my appeal with ESA but don not fancy the thought of this again.
Thank You in advance.

we have seen the worst assessments result in the highest award and the best result in no points at all!

Yes, you can address any issues you think that there were in the assessment but I would strongly recommend that you only do this once you have had sight of the report, or you risk talking yourself out of points.

Contact the DWP office dealing with your claim for the report.

Thank you Gordon. Can I telephone and request for one immediately please?
It would very much help in readiness for any problems that may transpire. My memory is such I need to act very soon. Hence this evening I have wrote notes from earlier.
Thank you again.

You can phone immediately but the DWP may not have received the report yet so there is a possibility that you will have to phone back next week.

Well I received my report yesterday. It is very clear I have failed. The report amongst other misworded things I did/did not say has given me a (C) on only preparing food and washing and bathing.
As any Epileptic will know, a nurse cannot possible understand and quote on paper what I am capable of. I immeadiately telephoned DWP whom advised I contact the independent Assessors and complain. This I did for which I am now awaiting a complaints form. I doubt very much this will have any bearing on my PIP decision, so I am left with what to do next?
I am tempted to address the DWP with my findings on the assessment form which I feel are incorrect, pre getting my refusal notice. What are your feelings on this? Address the issue now, or await it’s outcome?
What medical knowledge a Nurse has on complex retractable and drug resistant epilepsy is very little. I’m saddened I have to go through an appeal again. A mandatory decision is usually out of the question.
Any advice please?

Whilst there are conditions which require a doctor to carry out the assessment, Epilepsy is not one of them, they will have been only concerned with how often you have a seizure and therefore how often you need supervision.

However, a recent change to the guidelines means that they should be considering the risk of a seizure and the need for supervision that would result from this.

There is a narrow window for you to send more information to the DWP as we would typically expect a Decision to be made in 2-4 weeks, whether you want to do so or wait until you receive the Decision is up to you.
