Just a hypothetical question, so hopefully this is allowed.

If a person's capital goes over the £16k limit, can they remain on ESA in order to receive the NI credits towards their pension?

Or does going over the £16k mean they would lose their right to to any aspects of ESA? Even if the capital was expected to dip back under £16k after several months.

Going over the £16,000 limit removes entitlement to payment not your eligibility for ESA, so you would continue to receive NI Credits until your savings and assets drop below the limit again.

Be aware there is also a £6000 limit as well, see

Asset and savings rule for ESA(IR)

Gordan is the loss of esa payment only for esa (ir) if you have savings of this amount ?

Yes, the rules only applies to ESA(IR) and not ESA(CB).
