Having been on DLA since 2001, went through so many medicals and reviews and finally, several years later got DLA indefinitely only to be faced with another uphill battle to get PIP. A year ago the process started and I noticed along the way that the DWP always sent out forms and papers just before a public holiday, in effect cutting down the length of time I had to complete and return the documents. Some papers were dated 10 days before I actually got them, thus giving me only 18 days not 28 to get the completed and sent back. The DWP are up to all kinds of underhand tricks. But I wasn't going to go away. After the Mandatory Consideration, which is a sham, I knew I would have to be take my case to Appeal. This took place on Nov 20 and although, it was an hour long of having to try and explain my difficulties I finally won the appeal. I went from 0 points for Mobility to 8 points and 0 points for Care to 8 points. I have to say I personally felt I should have got 12 points for each as I can't use public transport and how my condition affects my social interaction wasn't appreciated as obviously I had to converse with the Tribunal panel. But it was a positive outcome and I have it for 5 years. BUT I haven't seen a penny of it yet, not even the £2.40 expenses from the Tribunal! Still I live in hopes that the DWP will concede and eventually cough up what they owe me. What I have to say, though, is that without your guides, newsletters, updates and fellow claimant letters, I would have been lost. The member guides are invaluable. Without the site claimants can easily start to go under in a quagmire of Political party stereotypes and institutional insensitivity towards vulnerable citizens. The DWP are the henchmen of the Treasury and the private companies conduct bogus Health Assessments for profit.

Congratulations on the result, well done.

It normally takes the DWP 5-8 weeks to process a Tribunal result, so I would not have expected you to have heard by now! One thing it is worth your doing is to contact the DWP to make sure that they have received the Decision Notice, they may also be able to tell you when you might receive you back pay.

As to the expense claim, chase the Tribunal Service.

Hi Gordon and Patricia my appeal was on 23rd November and I won, the clerk of the court told me they had already emailed the decision to DWP only minutes after decision was given and I should receive a letter from them 1/2 weeks after .if only! It seems they have ,28 days to respond and decide if they wish to appeal the court's decision and they are going to use the 28 days.which will in my case be 22nd Dec their last working day so don't expect any news until after new year.it seems never ending .it's taken a year this far and there's still uncertainty.i wonder if they write to say if they are appealing against the tribunal decision and if so what can I do regards angela

Yes you will receive notification from the Tribunal Service. You can argue against the DWP but not until you both receive a Statement of Reasons.

Ive read it can take three months to receive statement of reason,do DWP appeal the tribunal decision regularly? It's a 7and half month wait in my region to get to the tribunal appeal,I can't bear the thought it could be another 10/11 months or more before I get a decision .

It would be unusual for the DWP to take the matter further, I don't have any statistics but I would be very surprised if the percentage is in double figures.
